Resolution 13145CITY OF ALAMEDA RESOLUTION NO. 13145 APPROVING PARCEL MAP, PM -7299 AT AT 2201 SANTA CLARA AVENUE WHEREAS, an application was made on June 15, 1999 by the City of Alameda Housing Authority, for a land division for a vacant property; and WHEREAS, the application was accepted as complete on June 30, 1999 and has been found by the Engineering Department to be suitable for filing; and WHEREAS, the subject property is designated Medium Density Residential on the General Plan Diagram; and WHEREAS, the subject property is located in the R -6 (Hotel Residential Zoning) District; and WHEREAS, the Planning Board has recommeded that the property be rezoned to R -6 -PD (Hotel Residential, Planned Development Combining) District; and WHEREAS, the Planning Board held a public hearing on Auguat 23, 1999 to consider the Parcel Map recommended approval of Parcel Map, PM -7299 to the City Council; and WHEREAS, the City Council held a public hearing on September 21, 1999 to consider this application, and examined pertinent maps, drawings, and documents; and WHEREAS, the City Council has made the following findings regarding the proposed Parcel Map: 1. The proposal, with its design and improvement, is consistent with applicable General Plans and Specific Plans because the General Plan Land Use Element designates this site for Medium Density Residential uses. This project implements the General Plan Housing Element's policies to increase the supply of affordable housing units and the City's policy promoting home ownership. 2. The site is physically suitable for the type of development because the site is flat and has suitable access. The buildings comply with condominium (multiple house), building coverage, height limits, parking, and open space zoning requirements. 3. The site is physically suitable for the proposed density of development because the project complies with density requirements under the R -6 Zoning District and the General Plan, meets all Open Space requirements and off- street parking requirements. 4. The design of the land division or proposed improvement is not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat because the site is a vacant in -fill parcel in an urbanized area which does not contain any natural habitat. 5. The design of the land division or improvement will not conflict with easements acquired by the public at large for access through the property within the proposed land division because no such public easements exist on the property. 6. The design of the land division or the type of improvements are not likely to cause serious public health problems because there are no processes planned for this residential site which are likely to cause public health problems. NOW, THEREFORE, BE IT RESOLVED that the proposal is Categorically Exempt under the California Environmental Quality Act (CEQA), Section 15303, Construction of up to three new dwelling units in an urbanized area. BE IT FURTHER RESOLVED that the City Council has excepted the proposal from from undergrounding requirements. BE IT FURTHER RESOLVED that the City Council of the City of Alameda approves Parcel Map 7299, subject to the following conditions: The Parcel Map shall conform to plans dated June, 1999, on file in the Planning Department offices, titled "Tentative Parcel Map 7299," prepared by Robert A. Day Land Surveying, consisting of three sheets, and marked Exhibit "A ". 2. This approval shall expire two years from the date of City Council approval, unless a final Parcel Map has been recorded with the Alameda County Recorder, or the applicant applies for an extension at least 30 days prior to expiration, and is granted an extension. 3. The site improvements shall comply with the following: a. The site shall be graded to drain toward the street at a nominal slope of 1 %. All driveways, curbs and gutters and related improvements on the property shall be designed and approved to the satisfaction of the City Engineer. The existing curb cut on Santa Clara Avenue and portion of the curb cut on Walnut Avenue leading to the lot must be closed off to the City Engineer's satisfaction. c. All sidewalks, curb and gutters fronting the property that is damaged during construction shall be replaced to the City Engineer's satisfaction. d. Prior to the recordation of the Parcel Map, a copy of the Covenants, Conditions & Restriction's shall be provided to the Planning Director and the City Engineer for review and comment and shall be to the satisfaction of the Planning Director. e. Prior to the occupancy or sale of any unit, the Parcel Map shall be recorded. A Mylar of the recorded Parcel Map shall be provided to the City Engineer Office. 4. The three air rights condominiums shall be constructed in accord with the approval of the Planned Development, PD -98 -2, as set out in Planning Board Resolution, PB- 99 -72. I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly adopted and passed by the Council of the City of Alameda in regular meeting assembled on the 21st day of September , 1999, by the following vote to wit: AYES: Councilmembers Daysog, DeWitt, Johnson, Kerr and Mayor Appezzato - 5.
