MAKING FINDINGS REGARDING THE MITIGATION OF POTENTIALLY
SIGNIFICANT ENVIRONMENTAL IMPACTS AND OVERRIDING
CONSIDERATIONS FOR THE PROPOSED AGREEMENT BETWEEN THE
CITY OF ALAMEDA AND THE PORT OF OAKLAND REGARDING THE
OAKLAND HARBOR NAVIGATION IMPROVEMENT ( -50) PROJECT AND
LIMITED PARTY AGREEMENT
WHEREAS, on February 1, 2000, the Port of Oakland, as Lead Agency under the
California Environmental Quality Act ( "CEQA "), certified the Revised Final Environmental Impact
Report ( "RFEIR ") for The Oakland Harbor Navigation Improvement ( -50) Project and made
findings pursuant to section 21081 of the Public resources Code; and
WHEREAS the proposed Agreement Between The City of Alameda and The Port of
Oakland Regarding The Oakland Harbor Navigation Improvement ( -50) Project and Limited Party
Agreement are both contemplated within the RFEIR; and
WHEREAS, pursuant to section 15096(h) of the CEQA Guidelines, the City as a
Responsible Agency must consider the certified RFEIR and make Findings that project
environmental impacts have been mitigated to a less than significant level and/or that the Project has
benefits which override or outweigh the unavoidable environmental impacts.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Alameda:
Upon a full consideration of the Revised Final Environmental Impact Report
( "RFEIR ") for The Oakland Harbor Navigation Improvement ( -50) Project and comments before
the City Council and other evidence submitted on the record, the City Council makes the findings
attached as Appendix 1.

-50 foot Dredging Project
PART C: FINDINGS OF OVERRIDING CONSIDERATION
A. The project will significantly contribute to the regional, State and national economies by
providing expanded access to port facilities for the San Francisco Bay region.
B. The Project will protect and enhance the environment, in part by maximizing the
beneficial reuse of dredge material.
C. The Project will reduce tidal delays associated with container ship passages to and from
the Port of Oakland.
D. The Project increase economies of scale for waterborne commerce.
E. The Project will increase navigation safety by reducing the potential for vessel collisions
and groundings.
F. The Project will remove contaminated sediments from the channels at the Port of
Oakland and dispose of the material in an approved and environmentally sound manner.
G. The Project will n i.aimize the economic and fiscal impact to adjacent businesses to the
greatest extent possible and will provide spillover economic benefits to the City of Alameda and
other adjacent communities.
I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly
adopted and passed by the Council of the City of Alameda in regular meeting assembled on
the 15th day of February , 2000, by the following vote to wit:
AYES: Councilmembers Daysog, DeWitt, Johnson, Kerr and
Mayor Appezzato - 5.
NOES: None.
ABSENT: None.
ABSTENTIONS: None.
