Resolution 13231CITY OF AL EDA RESOLUTION NO. 13231 ACCEPTING THE TRANSFER OF HOUSING AUTHORITY EMPLOYEES TO THE CITY OF ALAMEDA AND AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT FOR SERVICES WITH THE HOUSING AUTHORITY TO PROVIDE HOUSING AUTHORITY STAFFING FUNCTIONS WHEREAS, the Housing Authority currently has 36 authorized employee positions, 28 of which are represented by Operating Engineers Local 3, and eight of which are unrepresented management positions; and WHEREAS, in addition to this in -house staffing, the Housing Authority contracts with the City of Alameda for the provision of police, community development, and legal services as well as the services of the Housing Authority Executive Director - -who is actually an employee of the City of Alameda, pursuant to various contracts for services between the Housing Authority from the City of Alameda; and WHEREAS, the City of Alameda Human Resources Department manages human resources functions for both the Housing Authority and the City of Alameda; and WHEREAS, these functions would be simplified and streamlined by transferring all Housing Authority employees to the City of Alameda and contracting back the staffing functions to the Housing Authority, similar to other services contracts between the Housing Authority and the City of Alameda; and WHEREAS, management for the Housing Authority and the City of Alameda have met and conferred with the representatives of Operating Engineers Local 3 regarding the conditions under which represented members would become City of Alameda employees, and such "meet and confer" requirements have been completed; and WHEREAS, conditions of the transfer of employees from Housing Authority to the City of Alameda would include that 1) all employees retain their original date of hire with the Housing Authority as their City of Alameda date of hire and 2) those employees who are currently represented by Operating Engineers Local 3 continue to be so represented under the existing Memorandum of Understanding approved by the Board of Commissioners on November 18, 1998 until its September 30, 2002 expiration, but as City of Alameda employees, be exempt from the Social Security system; and WHEREAS, Housing Authority management and confidential employees would be recognized as members of the Alameda Management and Confidential Employees Association with all the rights and responsibilities outlined in the existing agreement; and WHEREAS, Housing Authority employees as City of Alameda employees would have the benefit of the Public Employees Retirement System plan afforded other City employees and be exempt from the Social Security system; and WHEREAS, the Housing Authority and the City of Alameda would enter into an agreement for services to provide City employees for Housing Authority staffing functions. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Alameda, that the Council hereby approves the transfer by the Housing Authority of Housing Authority employees to the City of Alameda, under the provisions outlined herein, effective July 1, 2000: 1) Said employees shall retain the initial Housing Authority date of hire and all accrued vacation and sick leave; 1) Said employees shall retain the initial Housing Authority date of hire and all accrued vacation and sick leave; 2) formerly unrepresented Housing Authority management and confidential employees will be recognized as members of the Alameda Management and Confidential Employees Association; 3) members of existing Operating Engineers Local 3 shall retain their membership until the September 30, 2002 expiration of the existing Memorandum of Understanding approved by the Housing Authority Board of Commissioners on November 18, 1998; thereafter, said employees will be recognized as members of the Alameda City Employees Association; 4) all employees shall be enrolled in the Public Employees Retirement System plan as administered by the City of Alameda and shall be exempt from contribution to the federal Social Security system, consistent with all City of Alameda employees. BE IT FURTHER RESOLVED, that the City Manager is authorized to execute an agreement with the Housing Authority to provide City employees for Housing Authority staffing functions.
