Resolution 13264CITY OF ALAMEDA RESOLUTION NO. 13264 SETTING A HEARING DATE FOR CONSIDERATION OF VACATION OF MARKET STREET AT MADISON STREET WHEREAS, an application was made on February 29, 2000, by Sue Black, owner of property at the northwest corner of Madison and Market Streets, requesting vacation of 2,000 square feet of Market Street in order to have her 3,500 square foot residential lot increased by subsequent lot line adjustment to 5,500 square feet for a single - family building site; and WHEREAS, the lot line adjustment request was filed on May 9, 2000 and cannot be completed without City Council approval of a street vacation in Market Street; and WHEREAS, the subject property is designated as for Low Density Residential Development use on the General Plan Diagram; and WHEREAS, the General Plan does not designate Market Street at Madison Street as a significant street for preservation; and WHEREAS, the California Streets and Highways Code provides for the City Council to be able to grant a street vacation upon a finding of General Plan conformity and after receiving the recommendation of the Planning Board; and WHEREAS, the Planning Board considered the General Plan conformity request on July 24, 2000 to consider this application, and examined pertinent maps, drawings, and documents and recommended to the City Council that the street vacation be found in conformity with the General Plan and requested that the street vacation be approved; and WHEREAS, the City Council desires to set the hearing date for City Council review of this request. NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Council sets the hearing date for the Market Street vacation request as September 19, 2000 and directs staff to provide notice to property owners pursuant to the California Streets and Highways Code. I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly adopted and passed by the Council of the City of Alameda in regular meeting assembled on the 15th day of August , 2000, by the following vote to wit: AYES: Councilmembers Daysog, DeWitt, Johnson, Kerr and Mayor Appezzato - 5.
