FINDING VACATION OF MARKET STREET AT MADISON STREET
CONSISTENT WITH THE GENERAL PLAN AND APPROVING THE VACATION
WHEREAS, an application was made on February 29, 2000, in which Sue Black, owner of
property at the northwest comer of Madison and Market Streets, requested vacation of 2,000 square
feet of Market Street in order to have her 3,500 square foot residential lot increased by subsequent
lot line adjustment to 5,500 square feet for a single - family building site; and
WHEREAS, the lot line adjustment request was filed on May 9, 2000 and cannot be
completed without City Council approval of a street vacation in Market Street; and
WHEREAS, the subject property is designated for Low Density Residential Development use
on the General Plan Diagram; and
WHEREAS, the General Plan does not designate Market Street at Madison Street as a
significant street for preservation; and
WHEREAS, the California Streets and Highways Code authorizes the City Council to grant
a street vacation upon a finding of General Plan conformity and after receiving the recommendation
of the Planning Board; and
WHEREAS, the Planning Board considered the General Plan conformity request on July 24,
2000 to consider this application, and examined pertinent maps, drawings, and documents and
recommended to the City Council that the street vacation be found in conformity with the General
Plan and requested that the street vacation be approved; and
WHEREAS, on August 15, 2000 the City Council established September 19, 2000 as the
hearing date regarding the request; and
WHEREAS, on September 19, 2000 the City Council held a public hearing with notice as
required by the California Streets and Highways Code, and examined pertinent maps, drawings and
documents, as well as taking testimony.
NOW, THEREFORE, BE IT RESOLVED THAT the City Council of the City of Alameda
hereby determines that the proposal is Categorically Exempt under California Environmental Quality
Act Guidelines, Section 15305 - Minor Lot Line Adjustments; and
BE IT FURTHER RESOLVED that the City Council makes the following findings with
respect to the application for street vacation:
The City Council has already granted vacation of one -third of this segment of Market Street,
and only one interior lot would rely upon the remaining right -of -way.
2. After granting the vacation request, the interior lot will still have a 20 foot access to the rear
of the lot which can provide driving and turning radius for vehicles.
3. Adding 2,000 square feet of Market Street to the applicant's 3,500 square foot lot will create
a conforming single family residential lot in excess of the General Plan standard of 5,000
square feet, thereby implementing a portion of the General Plan.
4. Market Street is not designated on the General Plan as a street needing preservation for traffic
capacity or access purposes.
5. Market Street was platted in 1879 and is obsolete for traffic carrying purposes, and is
unnecessary for present or prospective public street purposes.
BE IT FURTHER RESOLVED that the City Council of the City of Alameda hereby finds the
street vacation in compliance with the General Plan, and of public benefit by placing land not needed
for street use on the tax rolls; and the City Council approves the street vacation, subject to
preservation of easements for utilities as required by the Public Works Director, to preservation of
turning dimensions for interior lot driveways, and to recording of a subsequent lot line adjustment
adding the vacated right of way to the applicant's site, Assessor's Parcel 69- 69 -11 -1, which
requirements shall be implemented to the satisfaction of the City Manager prior to transfer of City
property.
I, the undersigned, hereby certify that the foregoing Resolution was duly and
regularly adopted and passed by the Council of the City of Alameda in regular meeting
assembled on the 19th day of September 2000, by the following vote to wit:
