ADOPTING NEGATIVE DECLARATION, IS- 00 -03, FOR ` ZONING TEXT
AMENDMENT ZTA -00 -03 AND FOR REZONING R -00 -04 ESTABLISHING THE C -C
COMMUNITY COMMERCIAL ZONING DISTRICT AND RECLASSIFYING
PROPERTIES IN THE WEBSTER STREET AND PARK STREET BUSINESS
DISTRICTS FROM C -2 CENTRAL BUSINESS DISTRICT AND C -M COMMERCIAL
MANUFACTURING ZONING DISTRICTS TO C -C COMMUNITY COMMERCIAL
ZONING DISTRICT
WHEREAS, the City has been notified of the concerns of the Park Street Business Association
(PSBA) and the West Alameda Business Association (WABA) that many of the uses permitted or
conditionally permitted under the existing C -2 and C -M Zoning Districts could have significant
deleterious effects on the quality and character of the Webster Street and Park Street Business Areas
and that such effects could significantly reduce property values within the Business Areas; and
WHEREAS, the Park Street and Webster Street Business Areas represent the two "main street"
commercial areas within the City of Alameda; and
WHEREAS, the City of Alameda adopted an interim urgency ordinance on certain permitted
and conditionally permitted uses in the C -2 and C -M Zoning Districts within the Park Street and
Webster to provide time for the City to work with the Park Street Business Association and the West
Alameda Business Association to prepare amendments to the commercial district regulations for the
Park Street and Webster Street business districts; and
WHEREAS, the analysis has been completed and a revised zoning district has been proposed
for the Park Street and Webster Street business districts responsive to the purpose of the interim
urgency ordinance; and
WHEREAS, the subject property is designated Community Commercial on the General Plan
Diagram, a category with which the proposed new zoning district is compatible subject to approval of
the requested Amendment; and
WHEREAS, the subject property is located in the C -2 Central Business District and C -M
Commercial Manufacturing Zoning Districts; and
WHEREAS, the Planning Board has been advised that, and finds that, subject to meeting City
standards and requirements, the proposal would conform to the adopted Community Improvement Plan
(CIP) for the Business and Waterfront Improvement Project and General Plan policies incorporated by
reference within the CIP; and
WHEREAS, a proposed Negative Declaration and Initial Study was circulated for public
comment between October 6, 2000 to November 6, 2000, and no public comments were received; and
WHEREAS, the Planning Board held a public hearing on this application on November 13, 2000
and examined pertinent maps, drawings, and documents and recommended to the City Council the
adoption of the Negative Declaration; and
WHEREAS, the City Council considered the Negative Declaration at their meeting of December
5, 2000 and made the following findings:
1. The project does not have the potential to degrade the quality of the environment, substantially
reduce the habitat of fish or wildlife species, cause a fish or wildlife population to drop below
sustaining levels, threaten to eliminate a plant or animal community, reduce the number or restrict
the range of a rare or endangered plant or animal or eliminate important examples of California
history because the sites are covered with a combination of buildings, pavement and landscaped
area; therefore, there is no identified area which is habitat for rare or endangered species, the
project is within the scope of use contemplated in the General Plan and the project has no
significant adverse impacts.
2. The project does not involve impacts which are individually limited but cumulatively
considerable, meaning that the incremental effects of the project are considerable when viewed
in connection with the effects of past projects, the effects of other current projects and the effects
of probable future projects, because the described project constitutes all intended changes to the
project area and is not related to any other known project or policy change.
3. The project does not have any environmental effects which will cause substantial adverse effects
on human beings, either directly or indirectly because the proposed plan and ordinance changes
will be compatible with the existing community and commercial uses within the immediate area.
4. The project does not have the potential to achieve short-term, to the disadvantage of long -term,
environmental goals. The project would reinforce the vitality and viability of business districts
in Alameda, is consistent with the goals of the General Plan to provide commercial services at
the site and will not have any significant adverse impacts.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Alameda hereby
adopts the Negative Declaration (IS- 00 -03).
