Resolution 13408CITY OF ALAMEDA RESOLUTION NO. 13408 AUTHORIZING SOLE SOURCE REPAIR OF ENGINES AND GEARBOX FOR THE EXPRESS II CONVERSION PROJECT WHEREAS, on September 18, 2001, City Council authorized staff to issue a request for bids for the Express II ferry vessel conversion project; and WHEREAS, MAN Diesel was the original manufacturer of the Express II engine; and WHEREAS, repair work must be performed by a MAN Diesel authorized representative to ensure genuine manufacturer parts are used; and WHEREAS, MAN Diesel has granted the City free upgrade to correct problems incurred by earlier engines (including labor and materials) provided the repair work is performed by a MAN Diesel authorized representative; and WHEREAS, this project is funded under CIP -99 -01 and Harbor Bay Transportation Improvement Funds (TIF); and WHEREAS, Section 3 -15 of the City Charter provides that the City Council, by four affirmative votes, can authorize an open market purchase if it determines that the materials or supplies can be purchased at a lower price in the open market; and WHEREAS, the City Council has determined that the engine and gearbox repair for the Express II conversion can be obtained at a lower price in the open market, given the need to use genuine manufacturer parts and given the free upgrades available only from a MAN Diesel authorized representative. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Alameda, hereby authorizes, by four affirmative votes, the sole source procurement of engines and gear box repair for the Express II Conversion project. I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly adopted and passed by the Council of the City of Alameda in a regular meeting assembled on the 16th day of October, 2001, by the following vote to wit: AYES: Councilmembers Daysog, DeWitt, Johnson, Kerr and Mayor Appezzato - 5.
