Resolution 13414CITY OF ALAMEDA RESOLUTION NO.13414 AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE, ON BEHALF OF THE CITY OF ALAMEDA, TO SIGN AND FILE A FINANCIAL APPLICATION FOR A LOAN FROM THE STATE WATER RESOURCES CONTROL BOARD, AND DEDICATING A SOURCE OF REVENUE FOR THE REPAYMENT OF THE LOAN FOR INFILTRATION AND INFLOW, PHASE 8 SANITARY SEWER REPLACEMENT PROJECT, NO. P.W. 04 -01 -12 WHEREAS, on January 18, 1994, the City Council authorized participation in the State Revolving Loan Program for sanitary sewers rehabilitation and replacement; and WHEREAS, the loan application is for the eighth phase sanitary sewers' rehabilitation program designed to reduce or eliminate infiltration and inflow; and WHEREAS, the Public Works Department, CIP Division, has prepared plans and specifications for the project, which is scheduled for construction in June, 2002; and WHEREAS, the project contract cannot be awarded without a loan approval from State Water Resources Control Board; and WHEREAS, debt service on this loan application has been budgeted from the sewer service fund; < and WHEREAS, a loan application in the amount $2,870,000 is required for the construction of the project; and WHEREAS, in 1986, the East Bay Regional Utility District (EBMUD) prepared and certified a program level Environmental Impact Report (EIR) for the entire Infiltration and Inflow Correction Program (ICP). NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Alameda that the City Manager or his designee is hereby authorized and directed to sign and file for, on behalf of the City of Alameda, a loan from the State Water Resources Control Board in the amount not to exceed two million eight hundred seventy thousand dollars ($2,870,000) for the design and construction of the Infiltration and Inflow, Phase 8, Sanitary Sewer Replacement Project, No. P.W. 04- 01 -12. BE IT FURTHER RESOLVED that the City of Alameda hereby agrees and further does authorize the aforementioned representative or his designee to certify that the City of Alameda has and will comply with all applicable state and federal statutory and regulatory requirements related to any federal and state loan/grant funds received. BE IT FURTHER RESOLVED that the City Manager or his designee of the City of Alameda is hereby authorized to negotiate and execute a loan contract and any amendments thereto on behalf of the City of Alameda. BE IT FURTHER RESOLVED that the City of Alameda dedicates the sewer service fund as the funding source for the repayment of the State Revolving Fund Loan for Infiltration and Inflow, Phase 8, Sanitary Sewer Replacement Project, No. P.W. 04- 01 -12. * * * * * * I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly adopted and passed by the Council of the City of Alameda in a regular meeting assembled on the 20th day of November, 2001, by the following vote to wit: AYES: Councilmembers Daysog, DeWitt, Johnson, Kerr and Mayor Appezzato - 5.
