APPROVING FINAL MAP AND BOND, AUTHORIZING EXECUTION
OF SUBDIVISION IMPROVEMENT AGREEMENT AND
ACCEPTING DEDICATIONS AND EASEMENT VACATIONS FOR TRACT 7170
WHEREAS, pursuant to, Article 1, Chapter 3, Title XI of the Alameda Municipal Code, KB
Home South Bay, Inc., a California Corporation, owner and subdivider, Encinal Real Estate, Inc.,
A California Corporation, and City of Alameda, owners, have prepared and presented to this Council
the Final Map of the Subdivision known as Tract 7170; and
WHEREAS, the City Council approved a Tentative Map for a 152 unit subdivision known
as Marina Cove on November 21, 2000 and approved a Tentative Map Amendment on October 16,
2001, to allow that the Final Map could be filed in two Phases; and
WHEREAS, Tract 7170 is Phase I of two phases and consists of 83 residential lots and
parcels for park purposes and future phases development; and
WHEREAS, said Final Map delineates thereon for dedication to the City of Alameda public
streets, a park, easements for public utilities and rights for public safety vehicles and emergency
equipment; and
WHEREAS, said Final Map delineates an irrevocable offer of dedication of Ellen Craig
Avenue, a private street, for access for future residential development of adjacent northern property;
and
WHEREAS, the Amended Tentative Map provides for an irrevocable offer of dedication of
Parcel `E' for future use as Clement Avenue extension to be recorded as a separate instrument from
the Final Map ; and
WHEREAS, said Final Map delineates thereon vacation and abandonment of existing public
easements; and
WHEREAS, subdivider desires to enter into an agreement to construct and complete the
improvements in said subdivision, has filed the final map therefor for approval at this time, and has
posted its bond guaranteeing full and faithful performance of said work, all in accordance with said
Article; and
WHEREAS, it will be to the advantage and benefit of the City to have said work perfoinied
in accordance with said agreement.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Alameda that
the Final Map of Tract 7170 be, and hereby is, approved subject to Developer submitting proof of
the following duly signed documents with the final map:
1 Executed quit -claim documents for private easements to be abandoned with the final map;
2 Form of record notification to affected property owners of planned multi -modal corridor
along Clement Avenue;
3. Separate instruments for recordation of dedications that will not be accepted with the final
map;
4. Grant of a one -foot strip of land at the termination point of Clement Avenue improvements
constructed with this final map; and
5. Pay all outstanding invoices for staff charges.
BE IT FURTHER RESOLVED that said easements dedicated to the public and rights of
access dedicated to the City of Alameda are hereby accepted, on behalf of the public and the City,
for use in conformity with the tern's of the offers of dedication.
BE IT FURTHER RESOLVED that said public easements designated for abandonment are
hereby vacated.
BE IT FURTHER RESOLVED that the agreement for construction and completion of the
public improvements in said subdivision, and all its terms and conditions be, and hereby is, approved
and the City Manager and the City Clerk are authorized and directed to execute and attest to,
respectively, said agreement on behalf of the City of Alameda.
BE IT FURTHER RESOLVED that the Bonds in the total sum of $2,660,000 guaranteeing
full and faithful performance of said public improvements, and the bonds in the total sum of
$1,330,000 guaranteeing the labor and materials of said public improvements are hereby approved
as sufficient in amount.
I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly
adopted and passed by the Council of the City of Alameda in a regular meeting assembled on the 4th
day of December, 2001, by the following vote to wit:
AYES: Councilmembers Daysog, DeWitt, Johnson, Kerr and
Mayor Appezzato - 5.
NOES: None.
ABSENT: None.
ABSTENTIONS: None.
