Resolution 13534CITY OF ALAMEDA RESOLUTION NO. 13534 VACATING A PORTION OF CYPRESS STREET RIGHT -OF WAY EAST OF THIRD STREET WHEREAS, Cypress Street, between Third Street and Woodstock Park, is a 50 foot wide right -of -way; and WHEREAS, a capital improvement project, approved by the City Council on October 16, 2001, increased the street width to 20 -feet from curb to curb with no parking allowed; and WHEREAS, the approval of this capital improvement project authorized the vacation of the excess right -of -way with retention of a utility easement; and WHEREAS, on August 12, 2002, the Planning Board unanimously approved the finding that the abandonment conforms to the General Plan of the City of Alameda as required by Government Code Section 65402; and WHEREAS, the City of Alameda has conducted this vacation proceeding pursuant to the provisions of the California Streets and Highway Code, Chapter 3, Division 9, Part 3 (General Vacation Procedures) and particularly Section 8320 and 8323. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Alameda hereby approves vacation of a portion of the northerly Cypress Street right -of -way between Third Street and Woodstock Park. BE IT FURTHER RESOLVED, that the City Council hereby authorizes the City Manager or his designee to execute deeds of conveyance on behalf of the City of Alameda as required to complete vacation of Cypress Street right -of -way.
