GRANTING A NON-EXCLUSIVE FACILITIES EASEMENT AND A NON-
EXCLUSIVE 18-FOOT WIDE INGRESS AND EGRESS EASEMENT
BETWEEN CITY OF ALAMEDA AND ALAMEDA REAL ESTATE
INVESTMENTS WITHIN LOT 7 OF TRACT 6096
WHERAS, on October 11, 1989 Lot 7 of Tract 6096 was dedicated
to the City of Alameda for public access and open space and was filed in the
Office of the County of Alameda Recorder in Book 188 of Maps at Pages 1-8;
and
WHEREAS, existing public facilities consisting of restrooms, shower
and laundry facilities are located on Lot 7 of Tract 6096; and
WHEREAS, Alameda Real Estate Investments, a California limited
partnership, has requested a non-exclusive facilities easement to use the public
facilities as reasonably necessary in connection with the recreational use of if
Alameda Real Estate Investment, or successor's, adjacent marina; and
WHEREAS, Alameda Real Estate Investments, a California limited
partnership, has requested an 18-foot wide ingress and egress easement to
extend an existing 18-foot wide easement within Lot 7 of Tract 6096 to the
adjacent Lot 8, Tract 6096; and
WHEREAS, the public will still be allowed the use of the facilities in
order to remain in compliance with Bay Conservation and Development
Commission Permit # 39-79; and
WHEREAS said grant of easements contains maintenance
agreements to insure that facilities shall be operated, maintained and repaired
as determined by the City so facilities remain in a safe, sanitary and fully
operational condition; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Alameda that the grant of non-exclusive facilities easement and a non-
exclusive 18-foot wide ingress and egress easement between City of Alameda
and Alameda Real Estate Investments within Lot 7 of Tract 6096 are herby
accepted.
BE IT FURTHER RESOLVED that the City Clerk shall cause
certified copies of this resolution, attested under seal, to be recorded in the
County Recorder's Office.
I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly
adopted and passed by the Council of the City of Alameda in the regular meeting of the City
Council on the 7th day of March, 2006, by the following vote to wit:
