Resolution 14160CITY OF ALAMEDA RESOLUTION NO. 14160 AUTHORIZING OPEN MARKET PURCHASE FROM BERENDO SOLUTIONS, INC. OF LOS ANGELES, CALIFORNIA PURSUANT TO SECTION 3-15 OF THE ALAMEDA CITY CHARTER FOR ELECTRONIC CITATION SOFTWARE (REQUIRES FOUR AFFIRMATIVE VOTES) WHEREAS, the Police Department uses electronic citation software and hardware for traffic enforcement; and WHEREAS, the replacement and update of the current electronic citation system will allow for the ability to fully integrate with the Police Department's Record Management System, deliver citation data directly to the California Superior Court system, and improve current capabilities; and WHEREAS, the funds for this electronic citation software will be completely reimbursed by a Special Traffic Enforcement Program (STEP) grant from the California Office of Traffic Safety, through the National Highway Traffic Safety Administration; and WHEREAS, Section 3-15 of the City Charter provides that the City Council, by four affirmative votes, can authorize an open market purchase, without competitive bidding, if it determines that the product can be purchased at a lower price in the open market; and WHEREAS, after a solicitation of bids, Berendo Solutions, Inc. is the only company offering electronic citation software that is already capable of fully integrating with both the Police Department's Record Management System and the California Superior Court system, and therefore an open market purchase of this product from the sole source provider is effectively the "lowest price" available. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Alameda, pursuant to Section 3-15 of the City Charter, and by four affirmative votes, hereby authorizes the open market purchase of electronic citation software. I, the undersigned, hereby ,certify, that the foregoing Resolution was duly and regularly adopted and passed by the Council of the City of Alameda during the Regular Meeting of the City Council on the 20th day of November 2007, by the following vote to wit: AYES: Councilmembers deHaan, Gilmore, Matarrese, Tam and Mayor Johnson 5.
