Resolution 00384RES OLUT ION NO, 384. RESOLUTION ORDERING T1i E WORK (Res. of Int 30. 56, N.S.) WINIREAS, the Council of the City of Alameda did on the 5th day of April, 1921, pass its Resolution of Intention No. 56, N. S., to order the hereinafter described work to be done and improvement to be made in said Gity, which Resolution of (Intention was duly and regularly published as required by law, as appears from the affidavit of A. L. Hobe, now on file in the office of the City Clerk; AND 17HEI3EAS, notices Of the passage of said Resolution of Intention headed "NOTICE O ASSESS T" were duly and regularly posted conspicuously in such streets and portions there- of in which the proposed work is to be done and improvement to be made, in time , fonn and man- ner as required by law, as anpears from the affidavit of C. E. Hickok, who personally posted the same according to his affidavit on file in the office of the City Clerk, making oath that he completed the posting of said notices on the 9th day of April, 1921; IT 13 SMEBY RESOLVED that the public interest and convenience require the work hereinafter described, and the Council of the City of Alameda hereby orders the following work to be done and improvement to be made in said City, to wit: That concrete curbing be constructed on both sides of the following streets and highways in said city within the limitations mentioned; San Jose avenue, between the western line of High Street and the eastern line tre et ; of Mor Broadway, between the a- lee n line of Washington street and the southern line of Blanding avenue; Santa Clara avenue, between the eastern line of Park street and the western line of High street ; Encinal avenue, between the eastern line of lark street and the western line of High street; Bay street, between the northern line cf San Ant onio avenue and the southern line of Eagle avenue; Morten street, between the northern line of San Jose avenue and the southern line of Pacific avenue; Haight avenue, between the eastern line of Third street and the western line of Ninth street; Lafayette street, between the nortlern line of Clinton avenue and the southern line of Clement avenue; Oak street, between the northern line of Powell Boulevard and the southern line of Clime at ave nue ; Excepting therefrom any of said work already done to the official lines and grades. Al] of said work shall be done in accordance with the plans and specifications now on file in the office of the Street Superintendent of the City of Alameda, and refer- ence is hereby made to said plans' and speeifications for flu-tiler particulars and a descrip- tion of said work and improvement,. The Street Superintendent is hereby ordered and diredted to do said work and sake said imorovement, provided, the owners of three-fonrths of the area of lots and land liable to be assessed, or their agents, may, within ton (10) days after the passage of this resolu- tion enter into a written contract to make said improvement under the specifications and subject to the regulations adopted therefor. Should said owners fail to elect to take Reso1ution O. 384. said work and enter into such contract within the ten (10) days aforesaid, then it shall be the duty of the Street Superintendent to proceed with the making of said improvement, and upon the completion thereof to assess the cost upon the property benefited thereby in accordance with the provisions of Ordinance No. 137, New Series, of the City of Alameda. I hereby certify that the foregoing resolution. was duly and regularly introduced and adopted by the Council of the City of Alameda the 3rd. day of May, 1921, by the following vote: AYES: Councilmen Adams, Latham, Probst, Tilden and President Otis, (5), NOES: None.
