Resolution 05411RESOLUTION NO. 5411 APPROPRIATING- AND AUTHORIZING PAYMENT OF MONEY FOR SATISFACTION OF JUDGMENT, AND OTHER INCIDENTAL EXPENSES, IN CONDEMNATION PROCEEDINGS AGAINST CERTAIN REAL PROPERTY FOR PUBLIC OFF-STREET PARKING PURPOSES (KEENE) WHEREAS, by previous Resolution No. 5229, the City Attorney was instructed to proceed with condemnation proceedings against certain real property owned by George Eleanor Keene, administratrix with the Will annexed of the estate of George W. Murphy, deceased and George Eleanor Keene, individually, for the purpose of acquiring said property for public off-street parking purposes; and WHEREAS, the Superior Court of the State of California, in and for the County of Alameda, by stipulation, will render a judgment condemning said real property in the case of City of Alameda, a municipal corporation, Plaintiff, vs. George Eleanor Keene, administratrix with the Will annexed of the estate of George W. Murphy, deceased, et al., Defendants, No. 272131, to the use and benefit of the City of Alameda upon condition the City of Alameda pay unto the defendants therein the sum of $62,750.00; NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA: That there is hereby appropriated from the Off-Street Parking Project Construction Fund the amount of 63,050.00, to satisfy the said judgment regarding acquisition of the said real property, cost of title insurance, and other incidental expenses. That good and merchantable title in fee simple in said real property be vested in the City of Alameda by operation of said judgment, free and clear of all objections, liens, and encumbrances. That the title to said real property be evidenced by policy of title insurance issued by Oakland Title Insurance Company, a corporation, insuring title in the City, as provided in the preceding paragraph, said title insurance to be at the exrense of the City of Alameda. That upon execution and filing of a satisfaction of judgment by the defendants in City of Alameda, a municipal corporation, Plaintiff, vs. George Eleanor Keene, administratrix with the Will annexed of the estate of Georee W. Murphy, deceased, et al., Defendants, No 272131, and conditioned upon the issuance of a title insurance polipy, as aforesaid, to be approved by the City Attorney, a warrant of the City be drawn for $63,050.O0, payable to the order of and delivered to said Oakland Title Insurance Company, a corporation, as escrow holder, for the purpose of effecting the consummation of said purchase. * * * * * * * * * I, the undersigned, hereby certify that the foregoing Resolution was duly . and regularly introduced and adopted by the Council of the City of Alameda in regular meeting assembled on the 17th day of July, 1956, by the following vote, to wit: AYES: Councilmen Haag, Hove, McCall, Moresi and President Kranelly, (5).
