AUTHORIZING THE SOUTHERN PACIFIC COMPANY TO RETAIN
CERTAIN SALVABLE MATERIAL 10 TEE PERFORMANCE OF THAT'
CERTAIN AGBEEMENT REFERRED TO IN RESOLUTION NO. 5529
REGARDLESS OF STATUS OF LEGAL TITLE TO TEE LAND
INVOLVED, i.e., TILDEN WAYS
WHEREAS, Ordinance No. 1213 New 143, authorizes the acquisition of cer-
tain real property by the City. of Alameda, commonly hrown 03 Tildwn Way; and
WHEREAS, it is the intent of the City. of Alameda. that certain salvable
property as set out in. that agreement pursuant to Resolution No. 5529 Le retained by
the Southern Pacific ComraRq' regardless of status of legal title to the aforesaid
Tildpn Way; and
WHEREAS, great emergency' and necessity required immediate action as to the
retirement, relocation, removal and installation of railroad trawks and other railw
road equipment relating tp Tilden We as set out in the agreement authorized by Reso-
lution No. 5529;
NOM THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF AITAIRFDA thwt
14uthr: Pacific Company is hereby authorized to retain, regardless of status of
legal title to the aforementioned Titden Way, a that salvable property referred to
and governed by paragraph 1 (a) to 1 (c) and paragraph 1 (e) to 1 (01, iclusive,
of that certain agreement by and between the City of Alameda and the Southern Pacific
Company as apthsrized by Resolution No. 5529,
