ORDERING VACATION OF' UNUSED PORTION OF PUBLIC PURPOSE

BE ET RESOLVED BY THE COUNCIL OF THE CITY e ALAMEDA that an unused portion of that certain
easement heretofore dedicated for public purposes, to wit, a sanitary sewer, situated in the City of
Alameda, County of Alameda, State of California, end more particularly described as follows;
The most southerly thirty—eight (78) feet of the easement (six (0) feet
in width) described in the Deed of Easement from Robert MeSwing and Elsie M. McEwing
to the City of Alameda, recorded September 17, 195.8 Roch 5607, page 575, OfficisT
Reccrds of Alameda County,
is hereby ordered \faceted pursuant to the provisions of Section 50443 of the Government Code of
Calitornia.
BE rr FURTHER RESOINED that the Council of the City of ALemeda hereby finds and determines
that (I) the portion of said easement ordered vacated herein is unnecessary for present or prospecc
tive public usew and (2) the portion of the easement hereinabove described UGS dedicated and accepted
by the City of Alameda on Scptwmber 13, 1753S, end has not been used by said fjlty for any purpose
whatever since said date to and including the date of this resolution,
I, the undersigned, hereby certify that the fotegoing Resolution was duly and regularly
introduced and adopted by the Council of the City of Alameda in regular meeting assembled on the
41 h day of January, 1966, by the following vote, to witt
