Mayor Gilmore convened the meeting at 5:36 p.m.
Roll Call — Present: Councilmembers Chen, Daysog, Ezzy Ashcraft, Tam and
Mayor Gilmore — 5.
[Note: Councilmember Chen arrived at 6:06 p.m. and Councilmember
Daysog arrived at 6:09 p.m.]
Absent: None.
The meeting was adjourned to Closed Session to consider:
(13 -455) Conference with Real Property Negotiators (54956.8); Property: Alameda
Point; Negotiator: John Russo, City Manager; Negotiating party: Charles Company;
Under negotiation: Price and terms of payment
(13 -456) Conference with Real Property Negotiators (54956.8); Property: Alameda
Point; Negotiator: John Russo, City Manager; Negotiating party: Debartolo; Under
negotiation: Price and terms of payment
(13 -457) Conference with Legal Counsel — Anticipated Litigation; Initiation of litigation
pursuant to subdivision (c) of Section 54956.9; Number of cases: One (As Plaintiff - City
Initiating Legal Action)
(13 -458) Public Employee Performance Evaluation; Pursuant to Government Code §
54957; Position Evaluated: City Attorney - Janet Kern
Following the Closed Session the meeting was reconvened and Mayor Gilmore
announced that regarding Charles Company, the Council gave direction to staff;
regarding Debartolo, the Council gave direction to staff; and regarding Anticipated
Litigation, Council gave direction to staff.
Mayor Gilmore called a recess at 7:17 p.m. and reconvened the meeting at 11:05 p.m.
Following the Closed Session the meeting was reconvened and Mayor Gilmore
announced that regarding Performance Evaluation, the meeting was continued.
