CIC Resolution 00-84COMMUNITY IMPROVEMENT COMMISSION RESOLUTION NO. 00 - 8 4 APPROVING AND AUTHORIZING 1)AN AGREEMENT BETWEEN THE CITY OF ALAMEDA AND THE PORT OF OAKLAND TRANSFERRING REAL PROPERTY AND OTHER CONSIDERATION BETWEEN THE PARTIES, AND 2) A RELATED LIMITED PARTY AGREEMENT BETWEEN THE CITY OF ALAMEDA, THE PORT OF OAKLAND, BAY SHIP & YACHT COMPANY, AND ALAMEDA GATEWAY INC. WHEREAS, the Port of Oakland intends to proceed with a project to deepen the Alameda /Oakland estuary inner harbor to a depth of -50 feet and expand the Inner Harbor Turning Circle from 1,200 feet to 1,500 feet; and WHEREAS, the expansion of the Inner Harbor Turning Circle will require the conveyance of property both owned and leased by the City of Alameda and will impact several businesses within the City; and WHEREAS, the potential environmental impacts of the -50 Dredging Project have been analyzed by the Oakland Harbor Navigation Improvement Project Environmental Impact Report; and WHEREAS, in exchange for fair compensation and the implementation of appropriate mitigation for potential loss and disruption of Alameda businesses, the Community Improvement Commission desires to convey its interest in the real property necessary to complete the expansion of the Inner Harbor Turning Basin. NOW, THEREFORE, BE IT RESOLVED by the Community Improvement Commission of the City of Alameda that the City Manager of the City of Alameda, be and is hereby authorized to execute the Agreement Between the Port of Oakland and the City of Alameda in a form substantially similar to that Agreement Between the Port of Oakland and the City of Alameda on file in the Office of the City Clerk, for and on behalf of the Community Improvement Commission for the conveyance of real property and other consideration under the terms and conditions generally described in that Agreement. BE IT FURTHER RESOLVED that the City Manager of the City of Alameda, be and is hereby authorized to execute the Limited Party Agreement Between the Port of Oakland, the Bay Ship & Yacht Company and Alameda Gateway Inc., and the City of Alameda in a form substantially similar to that Limited Party Agreement Between the Port of Oakland, the Bay Ship & Yacht Company and Alameda Gateway Inc., and the City of Alameda on file in the Office of the City Clerk under the terms and conditions generally described in that Agreement. I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly adopted and passed by the Community Improvement Commission of the City of Alameda in specia' meeting assembled on the 7th day of March , 2000, by the following vote to wit: AYES: Commissioners Daysog, DeWitt, Johnson, Kerr and Chair Apperzsto - 5.
