RESOLUTION OF THE COMMUNITY IMPROVEMENT COMMISSION
OF THE CITY OF ALAMEDA APPROVING AND AUTHORIZING
THE EXECUTION OF AN OWNER PARTICIPATION AGREEMENT
WHEREAS, the City Council of the City of Alameda adopted
and approved a certain Plan (the "Plan") for the West End
Community Improvement Project (the "Project") by Ordinance No.
2141 on July 5, 1983; and
WHEREAS, in furtherance of the Project the Community
Improvement Commission of the City of Alameda (the "Commission")
wishes to enter into an Owner Participation Agreement which
provides that the Commi:2sion will assist the property owner in
providing certain public improvements (the "Improvements") necessary
for development of such property; and
WHEREAS, Section 33445 of the California Community
Redevelopment Law (Health and Safety Code Section 3300 et seq.)
provides thEt the Commission may, with the legislative body's
consent, pay for all or part of the value of the land for and the
cost of the installation and construction of public improvements
if the Commission and the legislative body make certain findings;
and
WHEREAS, the Marina Village Environmental Impact Report
evaluated the impacts of the proposed Alameda Marina Village proj-
ect and was certified by the Alameda City Council on July 17, 1979;
and
WHEREAS, the Alameda City Council approved a Master Plan
for the Marina Village project (MP 79-1) in November, 1979; and
WHEREAS, the Marina Village Environmental Impact Report
Supplement evaluated the impacts of the proposed amendment to the
Marina Village Master Plan and was certified by the Alameda City
Council on October 2, 1984; and
WHEREAS, the Alameda City Council approved a Master Plan
Amendment (MPA 84-1) for the Marina Village Project on October
2, 1984; and
WHEREAS, the Draft and Final Environmental Impact Report
for the Marina Village Projrzct (MP 79-1), and the Draft and Final
EIR Supplement for thr Master Plan Amendment (MPA 84-1), adequately
address the environmental impacts of this project. These reports
are determined to satisfy the requirements of the California
Environmental Quality Act.
NOW, THEREFORE, THE COMMUNITY IMPROVEMENT COMMISSION OF
THE CITY OF ALAMEDA DOES HEREBY RESOLVE as follows:
Section 1. The Commission hereby determines that the
improvements are of benefit to the Project Area and that no other
reasonable means of financing the Improvements is available to the
Community.
Section 2. The Commission further determines that instal-
lation and construction of the Improvements is redevelopment as
prescribed in Sections 33020 and 33021 of the Community Redevelop-
ment Law, that the Improvements will primarily benefit the Project
Area, and that none of the funds used to construct the Improvements
will be used to pay for employee or contractual services of any
local government agency except for services directly relating to
the installation and construction of the Improvements.
Section 3. Subject to the City Council's consent and their
making the findings set forth in Sections 1 and 2 hereof, the
Commission hereby approves and authorizes execution of the Owner
Participation Agreement attached hereto, and the Chairman and
Secretary of the Commission are hereby authorized and directed
to execute said Agreement on behalf of the Commission.
I" the undersigned, hereby certify that the foregoing Resolution
was duly and regularly adopted and passed by the Community Improvement
Commission of the City of Alameda in a regular meeting assembled on the
18th of December, 1984, by the following vote, to wit:
AYES: Commissioners Gorman, Hanna, Lucas, Nonsef and Chairman Diamert - 5.
NOES: None.
ABSENT: None.
