RESOLUTION NO. 91-49 •
APPROVING AND ADOPTING THE REPORT TO THE CITY COUNCIL ON
THE PROPOSED COMMUNITY IMPROVEMENT PLAN FOR THE BUSINESS
AND WATERFRONT IMPROVEMENT PROJECT, SUBMITTING SAID
REPORT, PROPOSED COMMUNITY IMPROVEMENT PLAN, AND FINAL
EIR RELATING THERETO TO THE CITY COUNCIL, AND CONSENTING
TO CALL A JOINT PUBLIC HEARING ON SAID COMMUNITY
IMPROVEMENT PLAN AND THE FINAL EIR RELATING THERETO.
WHEREAS, the Community Improvement Commission of the City
of Alameda (the "Commission ") has prepared a proposed Community
Improvement Plan (the "Community Improvement Plan ") for the
Business and Waterfront Improvement Project (the "Project "); and
WHEREAS, the Commission has submitted the proposed
Community Improvement Plan to the Planning Board of the City of
Alameda for its report and recommendations, and the Planning Board,
by Resolution No. 2157 adopted on February 25, 1991, reviewed the
proposed Community Improvement Plan and recommended the approval
and adoption of the proposed Community Improvement Plan; and
WHEREAS, pursuant to the California Environmental Quality
Act (Public Resources Code Section 21000 et sea.), the Guidelines
for Implementation of the California Environmental Quality Act (14
Cal. Code Regs. Section 15000 et sea., hereinafter the "State CEQA
Guidelines ") and local procedures adopted by the Commission
pursuant thereto, the Agency has prepared and completed a proposed
Final Environmental Impact Report (the "Final EIR ") for the
Project; and
WHEREAS, pursuant to Section 33352 of the California
Community Redevelopment Law (Health and Safety Code Section 33000
et sea.), the Commission has prepared a Report to the City Council
on the proposed Community Improvement Plan; and
WHEREAS, Section 33355 of the Health and Safety Code
authorizes a joint public hearing on the proposed Community
Improvement Plan with the consent of the Commission and the City
Council of the City of Alameda;
NOW, THEREFORE, THE COMMUNITY IMPROVEMENT COMMISSION OF
THE CITY OF ALAMEDA DOES RESOLVE AS FOLLOWS:
Section 1. The Commission hereby approves and adopts
the Report to the City Council on the Community Improvement Plan
for the Business and Waterfront Improvement Project and hereby
submits said Report, together with the proposed Community
Improvement Plan for the Project and the Final EIR, to the City
Council.
Section 2. The Commission hereby consents to a joint
public hearing on the proposed Community Improvement Plan for the
Project, and requests the City Council to call a joint public
hearing of the Commission and the City Council on May 21, 1991, at
7:30 p.m. in the City Council Chambers, City Hall, Room 200,
Alameda, California, to consider and act upon the proposed
Community Improvement Plan and all documents and evidence
pertaining thereto, together with a joint public hearing on the
Final Environmental Impact Report for the Project.
Section 3. The Secretary of the Commission shall, in
cooperation with the Clerk of the City of Alameda, prepare, publish
and mail such notices and documents and do all other acts as may
be necessary to carry out the purposes of this resolution.
I, the undersigned, hereby certify that the foregoing Resolution
was duly and regularly adopted and passed by the Community
Improvement Commission of the City of Alameda in regular meeting
assembled on the sixteenth day of April, 1991, by the following
vote to wit:
AYES: Commissioners Arnerich, Camicia, Thomas,
Withrow and Chairman Corica - 5.
NOES: None.
ABSENT: None.
ABSTENTIONS: None.
IN WITNESS, WHEREOF, I have hereunto set my hand and affixed the
official seal of said Commission this seventeenth day of April,
