RESOLUTION NO. 98-72
APPROVING AND ADOPTING THE REPORT TO CITY COUNCIL ON THE
PROPOSED COMMUNITY IMPROVEMENT PLAN FOR ALAMEDA POINT
IMPROVEMENT PROJECT, SUBMITTING SAID REPORT AND PROPOSED PLAN
TO THE CITY COUNCIL, AND CONSENTING TO A JOINT PUBLIC HEARING
ON SAID COMMUNITY IMPROVEMENT PLAN CONCURRENT WITH THE PUBLIC
HEARING OF THE COMMISSION ON THE DELAY OF APPLICATION OF
CALIFORNIA ENVIRONMENTAL QUALITY ACT TO THE PLAN ON FEBRUARY
17, 1998
WHEREAS, the Community Improvement Commission of the City of Alameda
(the "CIC") has prepared a proposed Community Improvement Plan (the
"Plan") for the Alameda Point Improvement Project (the "Project"); and
WHEREAS, the CIC has submitted the proposed Plan to the Economic
Development Commission (EDC) of the City of Alameda for its review and
recommendations, and the EDC on November 20, 1997 reviewed the proposed
Plan and recommended approval and adoption of the proposed Plan; and
WHEREAS, pursuant to Section 33352 of the California Community
Redevelopment Law (Health and Safety Code Section 33000 et seq.), the CIC
has prepared a Report to the City Council on the proposed Community
Improvement Plan; and
WHEREAS, Section 33355 of the Community Redevelopment Law authorizes
a joint public hearing on the proposed Community Improvement Plan with
the consent of the CIC and the City Council of the City of Alameda ("the
City Council"); and
WHEREAS, pursuant to Section 33492.18 of the California Community
Redevelopment Law, the CIC also desires to hold concurrently with the
joint public hearing on the Plan, a public hearing of the CIC to consider
and act upon a determination that the need to adopt the Plan at the
soonest possible time requires the CIC to delay application of the
provisions of the California Environmental Quality Act ("CEQA") to the
proposed Plan.
NOW, THEREFORE, BE IT RESOLVED by the Community Improvement
Commission of the City of Alameda, acting by and through its Chair and
members, as follows:
Section 1. The CIC hereby approves and adopts the Report to the
City Council on the Community Improvement Plan for the Alameda Point
Improvement Project and hereby submits said Report, together with the
proposed Community Improvement Plan for the Project, to the City Council.
Section 2. The CIC hereby consents to a joint public hearing on the
proposed Plan for the Project, and requests the City Council to call a
joint public hearing of the CIC and the City Council to consider and act
upon the proposed Plan and all documents and evidence pertaining thereto
and to consent to a concurrent hearing of the CIC to consider the delay
in application of CEQA to the Plan on February 17, 1998, at 7:25 P.M.
in the City Council Chambers, 2263 Santa Clara, Alameda, California.
Section 3. The Secretary of the CIC shall, in cooperation with the
Clerk of the City of Alameda, prepare, publish, and mail such notices and
documents and do all other acts as may be necessary to carry out the
purposes of this resolution.
I, the undersigned, hereby certify that the foregoing
Resolution was duly and regularly adopted and passed by the
Community Improvement Commission of the City of Alameda in special
meeting assembled on the 6th day of January , 1998, by the
following vote to wit:
AYES: Commissioners Daysog, DeWitt, Kerr
and Chair Appezzato - 4.
NOES: None.
ABSENT: Commissioner Lucas - 1.
ABSTENTIONS: None.
