ITEREAS public :Interest and necessity require that thb real. property
hereinafter described be acquired by the City of Alameda for public street and
highway purposes and. for the realignnent of Sbn Jose Avenue at Versailles Avenum;
and
WHEREAS, Margaret Richter, a widow, is the owner of the real property
hereinafter described and is willdng to sell. same to the City of Alameda for the
sum. of $200.00;

follows:
Section. 1 That the Cdty of 1( 17, purchase from Margaret Richter a

Alameda, Ccmnty of Alarbda, State of California, particularly described. as follows:
A portion of Lot 12 in Block "A", as shown. on "Plat of the
Lewellirg Dlvision, Alameda filed October 18, 1887 in the of-
fice of ""e 9bunty Recorder of Alanada County, and of record in.
Map Book 19, page 97, bounded as follows:
BEGINNING at a point on the northeastern line of San Jose
Avenue, as shown on said map, at the mbst 17' '0('7) corner of the
parcel of land conveyed. to City of Alameda, for street purruses,
by deed dated Decambmr 20, 1917 arb recorded in Book 2635 of
Deeds, page 149, Alameda County. Records; running thence north
56* 25, 40" west, along said line of San Jose Avenue 3.75 feet
to a point on a curvb to the left, heing the arc of a circle
with a 11171 of 179.55 feet; the center of said circle bearing
north 1.7* 46' 45" east., 172.55 feet from said point; thence
southeasterly, along said arc, a distance of 24.06 feet to the
intersection:. thereof with the nerthern line of said parcel. of
land. conveyed to City of Alameda; thence wbstbrly and northm
westerly, along said northern linm, (1 the arc of a cunve to
1- right, having a radins of a7.13 feet, a distance of 22.07

(a) That good, merchantable title in fee simple in said. real "13, '7
conveyed to teb City of almmede, free and clear of all objebtions, liens, enbum-
brancies, cloubs and claims of title, but subject to first instalimbet of taxes and
assossmants for Mae fiscal. year 1949-1950:
(b) That thb title to said real property- be evidenced by policy of title
insurance issued by the Alameda County-East Bay. Title '37717 Company, insuring
title in. the City of Alameda, as pmovided in the pmeceding subdivision (a);
(c) That upmn deposit with sald tdtla insurance company, for delivery to
the City of Alameda, of a good and sufficient deed of grant conveying said real
pnoparty to tbe City of Alabbda, and sonditimmbd upon. the ibsuance of a title in-
surance policy, as aforesaid,to be approved by the City Attorney, a warrant of tire
City of Alameda be drawn for Q200.00, payable to the order of said. Alameda County
East Bay Title insurance Company, a corporation, and delivered to said title insur-
ance company as escrow holder for the ''p(7" of effecting thb consummation of said
purchase.
Section 2. The Aum of 5215.00 is hereby appropriated from Gas Tax #2 Fund
of the City of Alameda to pay the purchase price of said real property and cost of
title "17") 0' policy.
I, the undersigned, hereby certify that the foregoing Resolution was
duly and regularly introduced and adopted by the Council of the City of Alameda
in nsgular necting assembled on the 12t1- day of October, 1949, by the following
vote, to wit;
