Resolution 04105220 RESOLUTION NC. 4105 DECIARING PUBLIC INTEREST AND NECESSITY REqUIRE SOL ANUISITION OF CERTAIN LANDS FOR PUBLIC SlhEET AND HIGHWAY PURPOSES, RESOLVED BY THE COUNCIL, CF THE CITY Cr ALAMEDA, and said Council hereby finds and determines that the public interest and necessity require the acquisition by said City of Alameda for use by said. City for public street and highway purposes, all cf those certain lots, pieces or parcels of land situate, lying and being in said City of Alameda, County of Alameda, State of California, and more particularly described as follows: PARCEL L. A portion of Lot 14 in Section. 10, Township 2 South Range 4 West, Mount Diablo Base and Meridian, as said lot is shown on 'Map No. 2 of Salt Marsh and Tide Lands, situate in the County of Alameda, State of California," bounded as follows: BEGINNING at the point of intersection of the center line of Third Street (60.00 feet wide); produced southerly with the south- western line of Central Avenue, formerly. Main Street (55.00 feet wide), produced southeasterly, as said streets: are shown on the Mao entitled, "Bayview Tract," filed June 29, 1922 in Book 7 of Maps, page 33, in the office cf the County Recorder of Alameda County; running thence along the said line of Third Street produced, south 3* 07' 15" west (the bearing south 3* 07' 15" west being assumed for the purpose of this description.), 29.26 feet; thence north. 55- 34' 54" west 126,00 feet, more or less, to a point on the western boundary line of said Lot 14; thence northerly along, the said last mentioned line 29.77 feet, more or less, to a point on the said southwestern line cf Central Avenue, (55.00 feet wide); thence southeasterly along the said last mentioned line to its direct production, 120.96 feet, more or less, to the point of beginning. Lally and wife, to City of Alameda, dated December 7, 1923 and recorded April 23, 1924 in Book 694 of Official Records of Alameda County, page 197; thence northwesterly along the said last mentioned line 219.00 feet, more or less, to the most western corner of the said parcel of land conveyed. to the City. cf Alameda; thence westerly in a direct line, 34.27 feet, more cr less, to the point of beginning. Street, (55.00 feet wide), produced southeasterly, as said streets are shown on the Map entitled, "Bayview Tract," filed June 29, 1022 In Book 7 of Yaps, page 33, in the office of the County Recorder of Alameda County; running thence along the said line of Third Street produced. south 3* 07' 15" west (the bearing south 3* 07' 15" west being assumed for the purpose of this description) 29.26 feet; thence south 55* 36' 30" east 425.09 feet; thence south- easterly along the are of a curve to the left, with a radius of 445.23 feet, tangent to the said last mentioned course, a distance of 229.00 feet, more or less, to a point on the northeastern boundary line ef Lot 18 in Section 10, Township 2 South, Range 4 West, Mount Diablo Base and Meridian, as said lot is shown on "Map No. 2 of Salt Marsh and Tide Lands, situate in the County of Alameda, State cf Callfernia," said last mentioned point being the actual point of commencement: thence continuing easterly along the arc of said curve to the left, wlth a radius of 445.23 feet, a distance of 10.39 feet, more cr less, to a point measured along the arc of said curve to the left, with a radius of 445.23 feet, southeasterly 245.30 feet from the southeastern extremity of that certain course designated as "south 55* 36 30" east 425,09 feet" herein mentioned; thence south 27* 11' 11" east4.96 feet to the intersection thereof with the western line produced. southerly of Fourth Street, formerly West End Avenue, as shown on the "Amended. Map of the Re-Subdivision of the Haight Tract," filed February 1.6, 1891 in the office of the County Recorder of Alameda County, and of record in Map Book 8, page 66; thence north 3* 03' 15' east along the said western lire of Fourth Street, produced, 56.39 feet to a point from which the center of a circle having a radius of 940.04 feet bears north 8* 52' 33" east distant 940,04 feet; thence westerly Along the arc of said circle having a radius of 040.04 feet, e dis tance of 58.80 feet, more or less, to the most western extremity of that certain course designated as "south 88* 45' east 50.39 feet" 111 the description in that certain_deed from :Frank 5, Haily and wife, to City of Alameda, dated December 7, 1923 and recorded April 23, 1924 in Book 694 of Official Records of Alameda County, page 197; thence westerly and northwesterly along the southern and. southwestern line of the parcel of land described in said deed to the City of Alameda, 349.95 feet, more or less, to a point on the northeastern boundary line of Lot 14 in said Section 10; thence southeasterly along the said last mentioned line, 75.00 feet, more or less, to Station 297, as shown on said "Map of No. 2 of Salt Marsh and Tide Lands;" thence southeasterly along the northeastern boundary lines of Lots 14, 19 ancF18, in said Section 10, a distance of 332,00 feet, more or less, to the actual point of commencement. ITESOLVED, FURTHER, that the City Attorney be and he is hereby, directed to commence condemnation proceedings in eminent domain for the acquisition of said lots, pieces or parcels of land, and that the Mayer be, end he Is hereby, instructed authorized and directed, for and on behalf of said City and its City Council, to subscribe to end verify a complaint in the Superior Court of said Alameda County for the condemnation of said lots,- pieces or parcels of land for public street and highway purposes. * * * * * * * * * * the undersigned, hereby certify that the foregoing Resolution was dtily and regularly Introduced and adopted by the Council of the City of Alameda In adjourned regular meeting assembled en. the 13th day of December, 1949, by the following vote, to wit: AYES: Councilmen Anderson, Jones, Osborn and President Brenscheld, (4).
