Resolution 04234370 RESOLUTION NO. 4234 CANCELLING CITY TAXES ON PROPERTY ACOCJIRED BY THE STATE OF CALIFORNIA FOR A STATE HIGIVAY. WHEREAS, the following described real property, situated in the City of Alameda, County of Alameda, State of California, to-wit: Lots 1, 2 and 3 in Block 19 of Alameda, according to the Map thereof filed July 24, 1879, in the office of the County Recorder of Alameda County and of record in Map Book 5, page 1, excepting therefrom the northeastern 10-2/3 feet of Lot 2 and the north- eastern 50 feet of Lot 9, has been assessed heretofore for City purposes for the fiscal year 1949-1950, and taxes levied thereon in the sum of $7.32 are uncollected and unpaid; and WHEREAS, after the time said taxes became a lien on said real property, to-wit, on May 19, 1950, said real property was, by deed. executed by Roberts Enter- prises, dated March 21, 1950, and recorded in the office of the County Recorder of Alameda County on May 19, 1959, acquired, and ever since has been, and now is, owned by the State of California, and has been and now is being used for public purposes, namely, a State Highway, and because of such public ownership is not sub- ject to sale for delinquent taxes; NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALA53191, with the written consent of the City Attorney attached hereto, that all uncol- lected taxes charged or levied for city purposes upon the aforesaid real property, together with penalties and costs thereon, be, and the same are hereby, cancelled, and the Auditor and Tax Collector of the City of Alameda are hereby authorized and directed to cancel the same on their respective hooks, and to remove said property from the assessment rolls. BE IT FURTHER RESOLVED, anything in this resolution to the contrary not- withstanding, that this resolution and order shall not be construed as cancelling or authorizing the cancellation of, any special assessment taxes levied against said real property by the City of Alameda pursuant to the provisions of the "Ac- quisition and Improvement Act of 1925". I, Stanley D. Whitney, City Attorney of the City of Alameda, State of California, do hereby consent to the cancellation of any and all uncellected taxes and assessments and penalties and costs thereon, charged or levied for city purposes upon the parcel of real property described in the within resolution.
