ALLOCATING ADDITIONAL FUNDS AND AUTHORIZING THE PUBLIC
WORKS DIRECTOR TO NEGOTIATE IN THE OPEN MARKT , PURSUANT
TO SECTION 3-15 OF THE CITY CHARTER , FOR THE BAY FARM ISLAND
DIKE EMERGENCY REPAIR PROJECT
WHEREAS , examination of the Bay Fann Island Dike current conditions indicates
three areas that need immediate repair work namely Shoreline Park across from Brunswick Road
Observation Platfonn across from Shamock Lane , and the Ship s Bow lookout; and
WHEREAS , a major storm will cause considerable damage to the above areas if not
repaired immediately; and
WHEREAS , plans and specifications and pennit application to Bay Conservation
and Development Commission (BCDC) and the Any Corps of Engineers are being prepared by
Moffat and Nichol Engineers; and
WHEREAS , open market negotiation is suggested to complete construction of the
project before the El Nino; and
WHREAS , in accordance with Section 3-15 of the City Charter , the Council may,
by four (4) votes , detennine that the great necessity or emergency requires immediate action and
thereupon proceed to acquire a contractor in the open market to make necessar repairs; and
WHEREAS , allocation of $93 000.00 from Reclamation District Deposit into CIP
94-15 is required for the constrction of the project.
NOW , THEREFORE , BE IT RESOLVED by the Council of the City of Alameda
that , pursuat to Section 3-15 of the City Charer , the City Council hereby allocates $93 000 from
Reclamation Distrct Deposit into CIP 94-, Bay Far Island Dike Emergenct Repair and
authorizes City Manager and/or designee to enter into an open market contract for the emergency
repair of the Bay Far Island Dike.
