CITYOFALAMEDARESOLUTIONNO.14782 RESOLUTIONOFINTENTIONTOLEVYANANNUAL ASSESSMENTONTHEPARKSTREETBUSINESS >.IMPROVEMENTAREAOFTHECITYOFALAMEDAFORFY13-14:g ANDSETAPUBLICHEARINGFORMAY 7,2013l.. ~WHEREAS,Section6-7ofArticleIIofChapterVIoftheAlamedaMunicipalCode .;;(establishestheAlamedaBusinessImprovementAreaoftheCityofAlameda(hereinafter ~"Area");and(.) ~WHEREAS,theAreacomprisesalloftheParkStreetBusinessAreaincludedby ~referenceonthemapandlistofinclusiveaddressesincludedinthisResolutionasExhibit Q 3and4,respectively;and ~ ~WHEREAS,theimprovementsandactivitiesauthorizedbytheOrdinanceinclude thegeneralpromotionofbusinessactivitiesintheArea,thepromotionofthepublicevents whicharetotakeplaceonorinpublicplacesintheArea,thedecorationofanypublic placeintheArea,thefurnishingofmusicinanypublicplaceintheArea,andthe acquisition,constructionormaintenanceofparkingfacilitiesforthebenefitoftheArea;and WHEREAS,agreementsbetweentheCityofAlameda(hereinafter"City")andthe ParkStreetBusinessAssociation(hereinafter"PSBA")designatedPSBAtoadminister BusinessImprovementArea(hereinafter"BIA")fundsfortheirrespectivegeographiczones oftheBIA;and WHEREAS,PSBAhasfiledreportswiththeCityClerkdescribingthesurplusor deficitrevenuestobecarriedoverfromFY2012-2013anddescribingtheimprovements andactivities,estimatedcostsandmethodsandbasisforlevyingtheassessmentforFY 2013-2014. NOW,THEREFORE,BEITRESOLVEDbytheCityCounciloftheCityofAlameda thatPSBAisherebydesignatedastheBIAAdvisoryBodyforFY2013-2014;and BEITFURTHERRESOLVEDthattheCityCouncilhasapprovedthePSBA assessmentreportforFY2013-2014;and BEITFURTHERRESOLVEDthattheCityCouncilherebysetsapublichearingto considertheannualassessmentfortheAreaforMay7,2013,atwhichtimewrittenororal protestsmaybemade;and BEITFURTHERRESOLVEDthattheCityClerkisherebydirectedtoadvertisesaid publichearingbycausingthisResolutionofIntentiontobepublishedonceinanewspaper ofgeneralcirculationintheCitynotlessthansevendaysbeforethepublichearing. ***** I,theundersigned,herebycertifythattheforegoingResolutionwasdulyand regularlyadoptedandpassedbytheCounciloftheCityofAlamedainaregularmeeting assembledonthe2nd dayofApril,2013,bythefollowingvotetowit: AYES:CouncilmembersChen,Oaysog,EzzyAshcraft,Tamand MayorGilmore-5.
