CITYOFALAMEDARESOLUTIONNO.14783 RESOLUTIONOFINTENTIONTOLEVYANANNUALASSESSMENTON OFALAMEDAFORFY2013-2014ANDSETAPUBLICHEARINGFOR MAY7,2013 >. (IIs::...o~ ~WHEREAS,Section6-7ofArticleIIofChapterVIoftheAlamedaMunicipalCodeuestablishestheAlamedaBusinessImprovementAreaoftheCityofAlameda(hereinafter "Area");and WHEREAS,theAreacomprisesalloftheWebsterStreetBusinessAreaincluded byreferenceonthemapandlistofinclusiveaddressesincludedinthisResolutionas Exhibit3and4,respectively;and WHEREAS,theimprovementsandactivitiesauthorizedbytheOrdinanceinclude thegeneralpromotionofbusinessactivitiesintheArea,thepromotionofthepublicevents whicharetotakeplaceonorinpublicplacesintheArea,thedecorationofanypublic placeintheArea,thefurnishingofmusicinanypublicplaceintheArea,andthe acquisition,constructionormaintenanceofparkingfacilitiesforthebenefitoftheArea;and WHEREAS,agreementsbetweentheCityofAlameda(hereinafter"City")andthe WestAlamedaBusinessAssociation(hereinafter"WABA")designatedWABAto administerBusinessImprovementArea(hereinafter"BIA")fundsfortheirrespective geographiczonesoftheBIA;and WHEREAS,WABAhasfiledreportswiththeCityClerkdescribingthesurplusor deficitrevenuestobecarriedoverfromFY2012-2013anddescribingtheimprovements andactivities,estimatedcostsandmethodsandbasisforlevyingtheassessmentforFY 2013-2014. NOW,THEREFORE,BEITRESOLVEDbytheCityCounciloftheCityofAlameda thatWABAisherebydesignatedastheBIAAdvisoryBodyforFY2013-2014;and BEITFURTHERRESOLVEDthattheCityCouncilhasapprovedtheWABA assessmentreportforFY2013-2014;and BEITFURTHERRESOLVEDthattheCityCouncilherebysetsapublichearingto considertheannualassessmentfortheAreaforMay7,2013,atwhichtimewrittenororal protestsmaybemade;and BEITFURTHERRESOLVEDthattheCityClerkisherebydirectedtoadvertisesaid publichearingbycausingthisResolutionofIntentiontobepublishedonceinanewspaper ofgeneralcirculationintheCitynotlessthansevendaysbeforethepublichearing. ***** I,theundersigned,herebycertifythattheforegoingResolutionwasdulyand regularlyadoptedandpassedbytheCounciloftheCityofAlamedainaregularmeeting assembledonthe2nd dayofApril,2013,bythefollowingvotetowit: AYES:CouncilmembersChen,EzzyAshcraft,Tamand MayorGilmore-4.
