CITYOFALAMEDARESOLUTIONNO.14792 APPROVEANAMENDMENTOFTHEJOINTEXERCISEOFPOWERS AGREEMENTCREATINGTHEALAMEDACOUNTYWASTE MANAGEMENTAUTHORITY WHEREAS,theAlamedaCountyWasteManagementAuthority(ACWMA)was' foundedin1976andcurrentlyoperatesunderaJointExerciseofPowersAgreement (JPA)mostrecentlyrevisedOctober10,2008,forthepurposeofpreparing,adopting, revising,amending,administering,implementing,andenforcingtheCountywide IntegratedWasteManagementPlanandAlamedaCountyHazardous ManagementPlan;and WHEREAS,theACWMA,aspartofitsStrategicWorkplan2020and developed-a collaborativelywiththeAlamedaCountySourceReductionandRecyclingBoard, initiatedacompletegovernancereviewin2010whichhasconcludedthataspecific amendmenttotheACWMAJPAwouldpromotetransparencyandefficiencyin government,and WHEREAS,Section8oftheexistingACWMAJPAdoesnotincludetypical languagethatstatesthememberagencyrulesthatgovernintheeventofaconflict betweenmemberagencyrules. BEITRESOLVED,thattheCityCounciloftheCityofAlamedaapprovesadding thefollowingsentencestotheendofSection8oftheexistingACWMAJPA:"The mannerofexercisingpowersgrantedbythisAgreementshallbesubjecttothesame restrictionsasimposedupontheCountyofAlameda.If atanytimetheCountyof AlamedaisnotapartytothisAgreement,themannerofexercisingpowersgrantedby thisAgreementshallbesubjecttothesamerestrictionsasimposeduponlargestcity withinAlamedaCountythatisaWasteManagementAuthoritymember." ****** I,theundersigned,herebycertifythattheforegoingResolutionwasdulyand regularlyadoptedandpassedbytheCounciloftheCityofAlamedainaregular meetingassembledonthe16th dayofApril,2013,bythefollowingvotetowit: AYES:CouncilmembersChen,Oaysog,EzzyAshcraft,Tamand MayorGilmore-5.
