Resolution 14802 CITY OF ALAMEDA RESOLUTION NO. 14802 AUTHORIZING THE CITY MANAGER TO SUBMIT A VEHICLE REGISTRATION FEE TRANSIT FOR CONGESTION RELIEF PROGRAM GRANT APPLICATION TO THE ALAMEDA COUNTY TRANSPORTATION COMMISSION FOR $489,000 TO CONTINUE OPERATION OF THE ESTUARY CROSSING SHUTTLE AND TO EXPAND THE HOURS OF OPERATION, TO COMMIT $90,000 IN TRANSPORTATION SYSTEMS MANAGEMENT/TRANSPORTATION DEMAND MANAGEMENT FUNDS AS A LOCAL MATCH AND FOR A CONTINGENCY, AND TO EXECUTE ALL NECESSARY DOCUMENTS WHEREAS, the City of Alameda (“APPLICANT”) has submitted an application to the Alameda County Transportation Commission (“ACTC”) for $489,000 from the following funding sources administered by the ACTC and programmed at ACTC’s discretion as part of the ACTC FY12-13 Coordinated Program (“PROGRAM”): Vehicle Registration Fee (VRF) Transit for Congestion Relief Program funding (collectively, “FY12-13 COORDINATED PROGRAM FUNDING”), for the Estuary Crossing Shuttle (“PROJECT”); and WHEREAS, the PROJECT will add 4.5 hours to the existing 8 hour per day Estuary Crossing Shuttle service, and will extend the service to mid-August 2016; and WHEREAS, the PROJECT is listed in the APPLICANT’s Bicycle Master Plan Update (2010), is a medium-priority in the APPLICANT’s Pedestrian Plan (2009) and is on the APPLICANT’s Implementation List for Competitive Grants and Regional Funding (2013); and WHEREAS, the APPLICANT represents that the APPLICANT is an eligible grant recipient for such VRF funds. NOW, THEREFORE, BE IT RESOLVED that the City Manager is authorized to submit a Vehicle Registration Fee Transit for Congestion Relief Program Grant Application to the Alameda County Transportation Commission for $489,000 to continue operation of the Estuary Crossing Shuttle and to expand the hours of operation; to commit $90,000 in Transportation Systems Management/Transportation Demand Management Funds as a local match and for a contingency, and to execute all necessary documents. BE IT FURTHER RESOLVED that the APPLICANT by adopting this resolution does hereby confirm and agree that: 1. APPLICANT will provide $90,000 in matching funds; and 2. APPLICANT understands that the amount of FY12-13 COORDINATED PROGRAM FUNDING for the PROJECT is capped at the amount approved by the ACTC, and that any cost increases must be funded by the APPLICANT from other funds, and that APPLICANT does not expect any cost increases to be funded with additional VRF grant funding; and 3. PROJECT will be implemented as described in the application, grant funding agreement and in this resolution; and 4. APPLICANT and the PROJECT will comply with the requirements as set forth in the PROGRAM Guidelines and grant funding agreement. BE IT FURTHER RESOLVED that the APPLICANT is an eligible sponsor of VRF funded projects. BE IT FURTHER RESOLVED that there is no pending or threatened litigation that might in any way adversely affect the proposed PROJECT, or the ability of the APPLICANT to deliver such PROJECT. BE IT FURTHER RESOLVED that the APPLICANT authorizes its City Manager, or other appropriate designee to execute a funding agreement with ACTC for FY12-13 COORDINATED PROGRAM FUNDING for the PROJECT as referenced in this resolution.
