TUESDAY- -APRIL 20, 1999- -7:30 P.M.
Mayor Appezzato convened the Regular Meeting at 7:37 p.m. Vice Mayor
Daysog led the Pledge of Allegiance. Pastor Don Taylor, Central Baptist
Church, gave the Invocation.
ROLL CALL - Present: Councilmember Daysog, DeWitt, Johnson, Kerr
and Mayor Appezzato - 5.
Absent: None.
AGENDA CHANGES
None.
PROCLAMATIONS, SPECIAL ORDERS OF THE DAY AND ANNOUNCEMENTS
(99 -176) Mayor Appezzato unveiled a portrait of former Councilmember
Charlie Tillman; announced the portrait would be on display in City Hall
for one month in memory of Mr. Tillman.
(99 -177) Presentation of First, Second and Third Place Awards for the
Clean Water Poster Contest as part of the City's Earth Day Celebration.
Mayor Appezzato announced that the Second Place winner Erica Tenoyan was
not in attendance; presented certificates to Third Place winner, Nina
Jimenez, and First Place winner, Sean Mitchell.
CONSENT CALENDAR
Mayor Appezzato announced that the letter opposing the Mandatory Social
Security Advisory Council's proposal [paragraph no. 99 -185] was
withdrawn from the Consent Calendar for discussion.
Councilmember DeWitt moved acceptance of the remainder of the Consent
Calendar.
Vice Mayor Daysog seconded the motion, which carried by unanimous voice
vote - 5. [Items so enacted or adopted are indicated by an asterisk
preceding the paragraph number.]
( *99 -178) Minutes of the Special and Regular City Council Meetings held
on April 6, 1999. Approved.
( *99 -179) Recommendation to authorize the 24th Annual Mayor's Fourth
of July Parade. Accepted.

( *99 -180) Designation of the City of Alameda's representatives to the
League of California Cities: Councilmember Kerr as Representative, Mayor
Appezzato as Alternate. Accepted.
( *99 -181) Recommendation to oppose AB 84 (Granlund), Political
Communities and Political Entities. Accepted.
( *99 -182) Recommendation to authorize appropriation of $338,000 from
the Fleet Industrial Supply Center Lease Revenue Funds for FY 1998 -99
and direct the City Manager to enter into the Advance and Repayment
Agreement with Alameda Reuse and Redevelopment Authority. Accepted.
( *99 -183) Recommendation to adopt the Pilot Downpayment Assistance and
Community Assisted Shared Appreciation (CASA) First Time Homebuyer
Programs; approve an Administrative Budget and appropriate $200,000 of
HOME funds for the CASA Program. Accepted.
( *99 -184) Recommendation to authorize contact with the Legislative
Delegation to amend State Redevelopment Law for the use of In -Lieu Funds
for Single Family Home Ownership. Accepted.
(99 -185) Recommendation to authorize the Mayor to write a letter to
Federal Representatives opposing the Mandatory Social Security Advisory
Council's proposal to mandate coverage for public agency employees.
Vice Mayor Daysog stated federal, State and local governments are not
truly distinct because activities at one level impact the other levels;
social security reform impacts everyone; that he supports the staff
recommendation to send letters; the federal government wants local
governments, with retirement programs other than social security, to
participate in social security. Vice Mayor Daysog reviewed the
structure and future of social security; further stated there are many
paths for reform, e.g. individuals investing in private programs; moved
acceptance of the staff recommendation; and encouraged Alameda residents
to stay attuned to the important debate.
Mayor Appezzato stated if [proposed social security] reform comes to
fruition, it would cost the City up to $1/2 Million.
Councilmember Kerr seconded the motion.
Under discussion, Councilmember Johnson stated the bottom line is that
the federal government wants the City's money.

( *99 -186) Recommendation to adopt Plans and Specifications and
authorize calling for Bids for Repair and Resurfacing of Certain

Streets, Phase 20, No. P.W. 03- 99 -09. Accepted.
( *99 -187) Recommendation to adopt Plans and Specifications and
authorize calling for Bids for Janitorial Services in Various City
Buildings Located in Alameda, California, for the Fiscal Year ending
June 30, 2000, No. P.W. 02- 99 -07. Accepted.
( *99 -188) Resolution No. 13101, "Resolution of Appreciation to the
Volunteers for the City of Alameda.
( *99 -189) Ratified bills in the amount of $2,072,027.23.
REGULAR AGENDA ITEMS
(99 -190) Recommendation to accept Guidelines for Responding to Hate
Crimes and Bias - Motivated Incidents.
Ed Dankworth, President, Social Service Human Relations Board [ SSHRB],
urged Council to accept the Guidelines; stated the Guidelines take a big
step toward eliminating hate crimes in Alameda; introduced SSHRB members
present.
Richard Neveln, Alameda, stated Council should take steps to eliminate
hate crimes; cautioned that all people can be subject to hate crimes,
not just one or two traditional groups; further stated writing
legislation and rules regarding hate crimes is a delicate area.
Councilmember DeWitt stated the [proposed] Guidelines are well written
and tactful; the [proposed Hate and Intolerance Response] Team is
composed of people with compassion; that he has found Alameda a pleasant
place to live; when he moved to Alameda, there was segregation; in spite
of institutional segregation, blacks, whites and other races got along
great in Alameda; Alameda is not a racist city; the City is putting
together a Team to ensure that victims and the public understand Alameda
is a city of harmony and justice; moved acceptance of the
recommendation.
Councilmember Kerr seconded the motion.
Under discussion, Councilmember Kerr thanked the people and
organizations who volunteered to serve on the Response Team.
Mayor Appezzato thanked the SSHRB, especially member Ken Werner; stated
the proposal should be effective.

ORAL COMMUNICATIONS, NON - AGENDA

(99 -191) Bonnie Halpern, Alameda Education Foundation, stated the
Alameda Unified School District (AUSD) is the lowest funded school
district in Alameda County; the Education Foundation has become involved
in discussions regarding new housing developments in Alameda; new
housing developments will have a tremendous impact on the quality of
education in Alameda; AUSD expects an influx of at least 1700 children
by the year 2005; every school is either at or over capacity; there is
no room for new students; new schools must be built; every developer who
constructs a house in Alameda, starting with the Kaufman & Broad
development at the Weyerhauser site, must pay the full mitigation fee
to ensure that Alameda schools remain quality schools.
COUNCIL COMMUNICATIONS
(99 -192) Mayor Appezzato read a letter which he received from Vice
Mayor Zhang Shu -fang from the City of Langfang, China regarding becoming
friendship cities and inviting Mayor Appezzato to visit.
(99 -193) Mayor Appezzato stated the City Council received a letter
from the State Controller, Kathleen Connell, regarding the FY 1997 -98
Single Audit Report Certification and Audit Finding performed by the
State of California; both the State and federal governments had no
findings noted; congratulated the Finance Director and staff.
(99 -194) Mayor Appezzato stated that he received a letter from Roger
Murphy regarding the ferry service contract; Hornblower Marine Services
[HMS] is directing efforts into bidding on contracts in two other cities
and might not bid in Alameda again; Roger Murphy has indicated he would
be interested in bidding independent of HMS; requested staff to review
whether Mr. Murphy could bid, e.g. legalities, and whether the Port of
Oakland would approve it.
(99 -195) Councilmember Kerr thanked the Council for appointing her as
the City's representative to the League of California Cities [LCC]
tonight; stated that she began attending LCC meetings before she was on
the City Council.
(99 -196) Councilmember Johnson requested staff to review the street
sweeping schedule on Webster Street; stated the parking is restricted
on the same day [of the week] as. the Farmer's Market; suggested moving
[street sweeping] to later in the day or a different day [of the week]
to allow parking on Webster Street during the Farmer's Market.
(99 -197) Councilmember Johnson stated that she received a call from
a resident who was not aware that the City has a Rent Review Advisory
Committee (RRAC) which deals with landlord tenant issues; City staff
told said resident to call Sentinel Fair Housing and did not inform the
resident of the RRAC; if the City receives calls regarding landlord
tenant issues, they should be directed to the RRAC routinely.

(99 -198) Mayor Appezzato inquired whether the street sweeping schedule
is reviewed on an regular basis, to which the City Manager responded in
the affirmative.
Mayor Appezzato further stated that he has received complaints from
resident who would like more tickets to be issued to cars which are not
moved prior to street sweeping; people are upset that gutters are not
swept and tickets are not issued.
(99 -199) Councilmember Johnson reported that the City and Council are
reviewing the [2411] Webb Avenue issue; although said matter is not on
the agenda tonight, it is not being ignored.
(99 -200) Consideration of Mayor's Appointment to the Mayor's Committee
for the Disabled.
Mayor Appezzato appointed Nina Ghiselli as a member of the Mayor's
Committee for the Disabled.
(99 -201) Councilmember DeWitt stated that the Public Works Department
is reviewing the creation of a Public Transportation Committee in
response to a suggestion from Richard Neveln; the City Manager has
indicated perhaps there will be formal action on the matter at the
second meeting in May.
Mayor Appezzato requested staff include the option of incorporation with
the Traffic Advisory Committee; suggested a subcommittee of two
Councilmembers should work with said Committee.
(99 -202) Councilmember DeWitt stated Mayor Appezzato was mentioned in
an Economic Development Alliance for Business [EDAB] publication
regarding his [Mayor Appezzato's] travels to China in March.

TUESDAY- -APRIL 20, 1999- -6:25 P.M.
Mayor Appezzato convened the Special Meeting at 6:30 p.m.
Roll Call -
Present: Councilmembers Daysog, DeWitt, Johnson, Kerr
and Mayor Appezzato - 5.
Absent: None.
The Special Meeting was adjourned to Closed Session to consider:
(99 -175) Conference with Labor Negotiator; Agency Negotiator:Human
Resources Director and Austris Rungis; Employee
Organizations: Alameda Management and Confidential Employees
Association - MCEA; International Association of
Firefighters, Local #689, IAFF; and Unrepresented Employees
(Bureau of Electricity) Management, Supervisors,
Professionals and Technicians.
Following the Closed Session, the Special Meeting was reconvened and the
Mayor announced that the Council gave instructions to the City's labor
negotiator, no action was taken.
Adjournment
There being no further business, Mayor Appezzato adjourned the Special
Meeting at 6:48 p.m.
