Following the Closed Session, the meeting was reconvened and the
Mayor announced direction was given to Legal Counsel.

TUESDAY- -DECEMBER 15, 1998- -7:30 P.M.
Mayor Appezzato convened the Regular Meeting of the City Council at
7:38 p.m. Cub Scout Bear Den Pack #78 presented the Colors and led
the Pledge of Allegiance. Elder John Pillitiere, Alameda Chapel,
gave the Invocation.

(98-659) Minutes of the Special and Regular City Council Meetings
of December 1, 1998. Approved.
Councilmember Lucas moved approval of the Minutes.
Councilmember Kerr seconded the motion, which carried by unanimous
voice vote - 5.
Farewell Comments by Council
(98-660) Councilmember Lucas commented on City government's
response to citizen's concerns; encouraged Alamedans to let local
government know what is important to them; stated during her time
on Council, diversity has increased in Alameda; two outstanding
Alamedans, former Mayor Anne Diament and former Councilmember Mark
Hanna, set an example for her; wished new Council success; stated
that she is looking forward to Beverly Johnson's new ideas and
energy; thanked Jim Sweeney for serving as her alternate on
B.R.A.G. and ARRA, the appointed officials and city staff for their
hard work, the Mayor and Council for their productive years, and
thanked her supporters for their help and advice.
Vice Mayor DeWitt stated Karin Lucas has been a representative of
the people and responds to those who call upon her; thanked her for
setting an example and for her dedication to the City of Alameda.
Councilmember Kerr stated she and Karin worked together first on a
City Council campaign and then sending out flyers in response to
the threat of rent control; that she [Councilmember Kerr] admired
her [Councilmember Lucas's] stand on the livability of Alameda's
neighborhoods; and thanked her for her years of service.
Councilmember Daysog stated that he learned from Karin Lucas's
leadership on tough issues and requested Karin to answer his calls

for advice.
Mayor Appezzato stated that he worked with Karin for 6 years;
although they have not always voted together, the strong friendship
bond was never broken; that he valued her judgement and will visit
her office when he needs advice; many things accomplished over the
last 6 years can be attributed to the professionalism and forward
thinking of Karin Lucas; and he thanked her on behalf of the entire
city.

(98 -661) Vice Mayor DeWitt moved that Council appoint
Councilmember Daysog as Vice Mayor.
Councilmember Kerr seconded the motion, which carried by unanimous
voice vote - 5.

Present: Councilmembers DeWitt, Johnson, Kerr, Vice
Mayor Daysog, and Mayor Appezzato - 5.

Comments by New Council
(98 -662) Lil Arnerich, former Councilman, commented on Alameda's
world class November 3, 1998 Municipal Election; stated said
election should set an example across the United States of

campaigns based on merit, not mudslinging; Vice Mayor Daysog and
Councilmember Johnson will fit in well with the Council; and read
comments, from a December 1996 newspaper article, which he made
regarding the time and effort Mayor Appezzato spends representing
the City.
(98-663) Councilmember Johnson thanked her supporters, Diane
Coler-Dark, her family, and fellow candidates; commented on
volunteerism and turning Navy Base conversion into a positive
thing; stated that she looks forward to listening to public input
and advice.
(98-664) Vice Mayor Daysog thanked his family, supporters, and
friends; stated during an era of limited means, he would like to:
1) partner with other agencies and 2) prioritize goals; commented
on the importance of volunteerism and diversity in the community.
(98-665) Mayor Appezzato thanked Judge Bartalini for administering
the Oath and Lil and Norma Arnerich for attending the meeting;
recognized City staff; complimented the Police Department and
volunteers serving on the City's Boards and Commissions; thanked
citizens, friends, Eric Cross, Ed Larkin, and his family.
AGENDA CHANGES

PROCLAMATIONS, SPECIAL ORDERS OF THE DAY AND ANNOUNCEMENTS
(98-666) Councilmember DeWitt stated Mayor Appezzato was chosen by
the Alameda County Mayors Conference to serve as a representative
to the Metropolitan Transportation Commission.
CONSENT CALENDAR
Councilmember Kerr requested acceptance of the Comprehensive Annual
Report [paragraph no. 98-668] be withdrawn from the Consent
Calendar for discussion.
Councilmember DeWitt moved approval of the remainder of the Consent
Calendar.
Vice Mayor Daysog seconded the motion, which carried by unanimous
voice vote - 5. [Items so enacted or adopted are indicated by an
asterisk preceding the paragraph number.]
(*98-667) Recommendation to accept the Annual Report of the
Community Improvement Commission. Accepted.
(98-668) Recommendation to accept the City of Alameda
Comprehensive Annual Financial Report for Fiscal Year Ended June

Report; moved approval of the staff recommendation.

(*98-669) Recommendation to accept Quarterly Sales Tax Report for
period ending September 30, 1998 for sales transactions in the
second calendar quarter. Accepted.
(*98-670) Recommendation to accept Audit Report for Pension Plans
1079 and 1082 for period ending June 30, 1998 (Maze and Associates,
Auditors). Accepted.
(*98-671) Recommendation to award a Consultant Contract in an
amount not to exceed $450,000 to Brady/LSA for the Fleet Industrial
Supply Center Environmental Impact Report and authorize the City
Manager to execute all necessary agreements and documents.
Accepted.
(*98-672) Recommendation to accept the work of Team Ace Joint
Venture for Upgrades to Building 90, 101 W. Atlantic Avenue, No.
P.W. 05-98-13. Accepted.
(*98-673) Recommendation to accept the work of Ranger Pipelines,
Inc. for Yosemite Avenue/Moreland Drive Sanitary Sewer Replacement

Councilmember Johnson moved adoption of the Resolution.
Councilmember DeWitt seconded the motion, which carried by
unanimous voice vote - 5.
The Clerk administered the Oath of Office and presented a
Certificate of Appointment to Ms. Gilmore.
(98-681) Ordinance No. 2785, "Approving and Authorizing the
Execution of the Prime Lease between the United States of America,
as Lessor, and the City of Alameda, as Lessee, for the Alameda
Facility of the Fleet Industrial Supply Center (FISC)." Finally
passed.
Vice Mayor Daysog moved final passage of the Ordinance.
Councilmember Kerr seconded the motion, which carried by unanimous
voice vote - 5.
(98-682) Ordinance No. 2786, "Approving and Authorizing the
Execution of a Sublease between the City of Alameda, as Sublessor,
and Dunavant of California, a Corporation, as Subtenant, for a
Portion of Building #2 at the Alameda Facility of the Fleet
Industrial Supply Center (FISC)." Finally passed.
Councilmember Kerr moved final passage of the Ordinance.

(98-683) Ordinance No. 2787, "Approving and Authorizing the

ORAL COMMUNICATIONS, NON-AGENDA
(98-684) Larry Bendel, SEIU Local 790 Staff Director, stated SEIU
Local #790 is the largest public sector union in Northern
California representing 26,000 members, including 25 City of

Alameda employees; that he is also representing the Alameda County
Central Labor Council, the Building Trades Council and Local #3
Operating Engineers; thousands of members of said organizations
live in the City of Alameda; the City Manager and Police Chief are
exploring contracting out the City jail; this would be the first
such jail north of Orange County; [contracting] sets a terrible
precedent; there has not been a RFP; working in a jail is
dangerous; employees [of jails] must be experts on laws and know
how to treat people; New York city pays $21.00 per hour with full
medical benefits and retirement, which is a typical to low-end wage
in the Bay Area; CSI, the company which the City has informally
approached, would pay their employees $8.50 per hour; contractors
make a profit by paying substandard wages; running a jail is a
civic responsibility; 90% of the people in Alameda's jail are
suspects, the people running the jail should be part of the
government not working for a contractor who is trying to make a
buck; [contracting] would save money, however, it would be a
terrible way to do so, deprive citizens of rights, and hurt people
trying to earn a living in law enforcement. Mr. Bendel submitted
letters from [two] labor organizations regarding the matter.
(98-685) Jim DuPont, Alameda resident and
Restaurant Workers Union, stated that he
dishwasher for $8.50 an hour; inquired how a
found for said wage; stated that he does not
to pay for lawsuits from criminals beat
incompetent workers; $3,000,000 liability in
half of a lawsuit; the City should look to
[spending].

(98-686) Judy Blank, Alameda Education Foundation, presented the
Mayor and Council with "The Game of Alameda"; thanked Council for
authorizing use of the City seal for the game; stated funds raised
will go to the [School District's] general fund and teachers will
receive $500 grants for classroom projects; listed various
locations to purchase said game.
(98-687) Richard Neveln, Alameda, stated perhaps there could be a
City Council historian; on December 15, 1791 the Constitution's
first ten amendments, the Bill of Rights, became effective; on
December 14, 1896 a local hero, James Harold Doolittle, was born in
Alameda; summarized James Doolittle's accomplishments; further
stated [airplane] hangars which may have been used by James
Doolittle and Amelia Earhart are located on the Fleet Industrial
Supply Center; the Navy legacy in Alameda should be preserved.
COUNCIL COMMUNICATIONS
(98-688) Councilmember Kerr stated the City has received a lot of
communications about speeding; 25 mph signs which were painted on
the streets have disappeared as streets have been repaved; it is

difficult to find speed limit signs in the City, particularly near
schools; restoring white signs painted on the pavement might be an
inexpensive way to remind people [of the speed limit] and slow down
traffic; people do not like signs posted in front of their houses,
painting streets would be a reasonable alternative; the Police
Department goes to the trouble of placing speed reading devices on
busy streets as a reminder to slow down.
The City Manager stated staff will follow up with an off-agenda
report.
(98-689) Councilmember Daysog thanked Mr. Dicolen and his family
for their support.
(98-690) Mayor Appezzato wished everyone a happy and fruitful
holiday season.
