Ordinance 3090CITY OF ALAMEDA ORDINANCE NO. 3090 New Series APPROVING A LEASE AND AUTHORIZING THE CITY MANAGER TO EXECUTE DOCUMENTS NECESSARY TO IMPLEMENT THE TERMS OF THE LEASE WITH COMPLETE COACH WORKS FOR TWELVE MONTHS IN A PORTION OF BUILDING 24 AT ALAMEDA POINT, 2301 MONARCH STREET WHEREAS, American Bus Repair, LLC dba Coach Specialties (ABR) has been a tenant in Building 24 at Alameda Point since August 1997; and WHEREAS, in May 2000, the City approved an assignment of the lease to ABR and ABR has since sold the business to Complete Coach Works; and WHEREAS, Complete Coach Works uses the facility for painting all types of vehicles including the repainting of the historic A-4 displayed at Alameda Point, original London double decker buses and industrial vehicles; and WHEREAS, Building 24 is a large hangar with three bays; and WHEREAS, Complete Coach Works occupies Bay 3 which is approximately 14,997 square feet in the building with an adjacent parking area; and WHEREAS, the previous rent paid by ABR was $6,625 monthly. The proposed 12-month lease with Complete Coach Works for Bay 3 of Building 24 requires payment of $10,480 monthly. The tenant will also be required to increase the amount it holds as a security deposit equal to one month rent and the lease contains the standard insurance, indemnity, assignment and termination clauses the City of Alameda requires in its leases and compliant with the Lease in Furtherance of Conveyance (LIFOC) with the United States Navy. NOW THEREFORE, BE IT ORDAINED by the City Council of the City of Alameda that by four affirmative votes that: Section 1. The City Manager of the City of Alameda or his designee is hereby authorized to negotiate, execute, for and on behalf of the City of Alameda, a lease with Complete Coach Works for a portion of Building 24 at Alameda Point located at 2301 Monarch Street for a term of twelve months, subject to such technical or clarifying revisions as are reasonably determined necessary by the City Manager and approved by the City Attorney, and the City Clerk is hereby authorized and directed to attest to the same. Section 2. If any section, subsection, sentence, clause or phrase of this ordinance if, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this ordinance. The City Council of the City of Alameda hereby declares that it would have passed this ordinance, and each section, subsections, clause, or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases are declared to be invalid and unconstitutional. Section 3. This ordinance shall be in full force and effect from and after the expiration of thirty (30) days from the date of its final passage.
