AMENDING SUBSECTION 2-63.10 (RETENTION FOR
PUBLIC USE) OF SECTION 2-63 (LOST , STOLEN AND
UNCLAIMED PROPERTY) , OF ARTICLE
(ADMINISTRATIVE PROCEDURES AND POLICIES),
CHAPTER II (ADMINISTRATION) RELATING
DISPOSITION OF UNCLAIMED PROPERTY TO NON-
PROFIT CORPORATION PROVIDING PUBLIC SERVICE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALAMEDAthat:
section The Alameda Municipal Code is hereby amendedby amending subsection 2-63.10 (Retention for Public Use) ofsection 2-63 (Lost , Stolen and Unclaimed Property), of Article V(Administrative Procedures and Policies) , Chapter II
(Administration) to read as follows:
2-63.Retention for Public Use
If the city Finance Director or his/her designee
determines that any such property transferred to him/her for sale
is needed for a pub ic use , such property may be retained by theci ty, or transferred to a non-prof it corporation which has entered
into a written agreement with the City or received a grant from theci ty to provide public services.
section That is any section , subsection , sentenceclause, or phrase of this ordinance is , for any reason, held to be
invalid or unconsti tional , such decision shall not affect the
validi ty or consti tutionali ty of the remaining portions of this
ordinance. The City Council of the City of Alameda hereby declares
that it would have passed this ordinance and each sectionsubsection, clause or phrase hereof , irrespective of the fact that
any one or more sections , subsections , sentences , clauses and
phrases are declared to be invalid or unconstitutional.
section This ordinance shall be in full f.rce and
effect from and after the expiration of thirty (30) days from the
date of its final passage.
