AMENDING THE ALAMEDA MUNICIPAL CODE BY REPEALING
EXISTING SECTION 24-5 (SMOKING CONTROL) OF
CHAPTER XXIV (PUBLIC HEALTH)
AND ADDING A NEW SECTION 24-5 (SMOKING CONTROL)
ENFORCING LABOR CODE SECTION 6404.
WHEREAS , Assembly Bill 13 (T. Friedman) Smoking in
Enclosed Places became effective January 1 , 1995 and is codified
in Labor Code section 6404.et seq .; and
WHEREAS, Assembly Bill 13 establishes
standards for smoking in places of employment; and
state-wide
WHEREAS, City of Alameda Ordinance No.2 3 64 , adopted by
the City Council on November 3 , 1987 , regulated smoking in public
places , restaurants, hotels , motels , and places of employment i and
WHEREAS, Assembly Bill 13 supersedes the existing City
Ordinance No.2 3 64 in areas where the City Ordinance is weaker; and
WHEREAS , City of Alameda Ordinance No. 2364 currently
prohibits smoking in bingo parlors i and
WHEREAS , the prohibition of smoking in bingo parlors is
not included in the provisions of Assembly Bill 13.
NOW , THEREFORE , BE IT ORDAINED by the Council of the City
of Alameda that:
Section 1 The Alameda Municipal Code is hereby amendedby repealing section 24-5 (Smoking Control), of Chapter XXIV
(Public Health), in its entirety.
section 2 The Alameda Municipal Code is hereby amended7 adding a new section 24-5 (Smoking Control) to Chapter XXIV
(Public Health) to read as follows:
24-05 SMOKING CONTROL.
24-5.Enforcement of Regulation of Smoking in the
Workplace.
The City of Alameda will enforce the regulations of
smoking in the workplace as set forth in Section 6405.5 of the
Labor Code , as amended, with the exception of that portion of
section 6404.5 (f) (1) addressing Gaming Clubs.
24-5.Prohibi ting Smoking Gaming Clubs/Bingo
Rooms.
Smoking shall be prohibited in Gaming Clubs/Bingo Rooms
wi thin the City of Alameda.
Section This ordinance shall be in full force and
effect from and after the expiration of thirty (30) days from thedate of its f ina 1 passage.
