APPROVING AND AUTHORIZING EXECUTION
EASEMENT PURCHASE AGREEMENT BETWEEN EAST BAY
MUNICIPAL UTILITY DISTRICT AND THE CITY OF
ALAMEDA
WHEREAS , on April 6 , 1995 , EBMUD presented to the City
Alameda an offer for the acquisition of easements from the City for
the installation of a one million gallon underground storage basin
and above ground electrical transformer jconduit for the purpose of
storage and treatment of wet weather fLows; and
WHEREAS the easement . acquisitions are part
EBMUD I S wet weather program approved by the EBMUD Board
Directors on September 23 , 1986; and
the
WHEREAS , permanent
requested by EBMUD; and
and temporary easements are being
WHEREAS , $293 142 is offered to the City of Alameda in
the following manner:
( a)The improvements will be done by EBMUD.
(b) EBMUD will be responsible for
resulting from disposal of contaminated soil.fees and taxes
WHEREAS , the City Council of the City of Alameda has
determined that this project is categorically exempt under theCalifornia Environmental Quality Act Guidelines Section 15305
(Minor Alterations in Land Use Limitations), Subdivision (a)
because it grants an easement.
NOW , THEREFORE , BE IT ORDAINED by the Council of the City
of Alameda that:
Section The City of Alameda approves and authorizes
execution of the East Bay Municipal Utility District Easement
Purchase Agreement , a copy of which is on file in the Office of theci ty Clerk , granting permanent and temporary easements to EBMUDlocated at the north east side of otis Drive , City of Alameda
County of Alameda , State of California.
Section 2 The City Manager and the City Clerk , be , andeach hereby is , authorized and directed to execute and to attestto , respectively, on behalf of the City of Alameda , the grants of
said easements to EBMUD.
Section This ordinance shall be in full force and
effect from after the expiration of thirty (30) days from the date
of its final passage.
