APPROVING AN AUTHORIZING EXECUION OF AN AMENDMENT
TO LEASE OF REAL PROPERTY (TIDAL CANAL) BETWEEN
CITY, AS LESSOR , AND DIETER AN HELENE RAE,
LESSEES, AT 3363 FERNS IDE BOULEVARD
WHEREAS, on August 4, 1987 , the City Council adoptedOrdinance No. 2356, authorizing the lease of tidal canal real
property at 3363 Fernside Boulevard to Dieter and Helene Rabe; and
WHEREAS, the City of Alameda and Dieter and Helene Rabe
desire to amend said lease to allow improvements which extend onto
the leased land; and
WHEREAS, the term of this lease shall be for the period
of twenty-five (25) years from September 4, 1987, unless said term
shall be sooner terminated; and
WHEREAS, the proposed lease amendment does not have asignificant effect on the environment, and thereforestatutorily exempt under Section 15301 (e) (1) of the CEQA
(California Environmental Quality Act) Guidelines; and
WHEREAS, a form of lease containing the covenants , terms
and conditions to be entered into is on file in the office of the
Ci ty Clerk of the City of Alameda; and
WHEREAS, pursuant to City Charter section 3-10, no real
property of the City shall be leased for a period in excess of one
year or sold, except upon the affirmative vote of four members of
the City Council.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City
of Alameda, and upon the affirmative vote of four members of theCity Council that:
Section 1 That the form of amendment to lease referred
to in the preamble hereof , and the terms , conditions and covenants
contained therein are hereby approved.
Section 2 The Mayor of the City of Alameda, be, and he
hereby is, authorized to execute on behalf of said City the
Amendment to Lease of Real Property (Tidal Canal) between the City
of Alameda (Lessor) and Dieter nd Helene Rabe (Lessee (s) at 3363
Fernside Boulevard, and the City Clerk is directed to attest to the
same.
Section This ordinance shall be in full force and
effect from and after the expiration of thirty (30) days from the
date of its final passage.

I, the undersigned, hereby certify that the foregoing Ordinance was
duly and regularly adopted and passed by the Council of the City of
Alameda in regular meeting assembled on the 6th day of
Auqust , 1996 by the following vote to wit:
