APPROVING AND AUTHORIZING EXECUTION OF AN AMENDMENT TO
LEASE OF REAL PROPERTY BETWEEN CITY, AS LESSOR , ANDALEDA SWIMMING POOL ASSOCIATION, AS LESSEE FOR
SWIMMING POOL FACILITIES AT LINCOLN AN FRAKLIN PARKS
WHEREAS, r.he City of Alameda and the Alameda Swimming
Pool Association, a non-profit corporation , previously entered into
lease of certain City oy.med properties, being portions of
Franklin Park and Liucoln Park; and
WHEREAS, the City of Alameda and the Alameda Swimming
Pool Association now desire to enter into an amended lease for the
same properties; and
WHEREAS, the term of this amendment to lease shall be for
five years, expiring May 31, 2001; and
WHEREAS, the proposed lease amendment does not have asignif icant effect on the environment, and therefore, isstatutorily exempt under Section 15301 (e) (1) of the CEQA
(California Environmental Quality Act) Guidelines; and
WHEREAS, a form of lease containing the covenants, terms
and conditions to be entered into is on file in the office of the
Ci ty Clerk of the City of Alameda; and
WHEREAS , pursuant to City Charter section 3 -10, no real
property of the City shall be leased for a period in excess of one
year or sold, except upon the affirmative vote of four members of
the City Council.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City
of Alameda, and upon the affirmative vote of four members of theCity Council that:
Section 1 That the form of amendment to lease referred
to in the preamble hereof, and the terms, conditions and covenants
contained therein are hereby approved.
Sect ion 2 The Mayor of the City of Alameda be, and he
hereby is, authorized to execute on behalf of said City said
Amendment to Lease between the City of Alameda (Lessor) and the
Alameda Swimming Pool Association. (Lessee) and the City Clerk is
hereby directed to attest to same.
Section 3 This ordinance shall be in full force and
effect from and after the expiration of thirty (30) days from the
date of its final passage.

of the City of Alameda in regular meeting assembled on the 6th
