AUTHORIZING TRASFER BY GRAT DEED OF CERTAIN
CITY OWNED REAL PROPERTY (ALONG ATLANTIC
AVENUE) TO THE COMMUITY IMPROVEMENT
COMMISSION OF THE CITY OF ALAMEDA
WHREAS , a Joint Meeting of the Community Improvement Commission, Housing
Authority Board of Commssioners and the City Council was held on June 3 , 1997 approving a
Disposition and Development Agreement (DDA) with Browman Development Company (BDC)
authorizing the sale of propert located at the site of Webster Street and Atlantic Avenue; and
WHEREAS , as described in the DDA, the site at Webster and Atlantic consists of several
parcels of real propert and varous pieces of public right-of-way; and
WHEREAS , the properties which comprise the site are owned by the City of Alameda
Alameda Beltine Railroad and the Housing Authority of the City of Alameda; and
WHEREAS , the properties owned by the City and the Housing Authority will be
conveyed to the CIC by each of the owners of the properties and then to BDC in a simultaeous
a: escrow , as described in the City-CIC Cooperation and Payment Agreement and the Housing
Authority-CIC Cooperation and Payment Agreement , copies of which are on file in the Office of
the City Clerk; and
WHEREAS , the propert owned by the City consists of approximately 21 171 square
feet, which is owned in fee , and two easements for right-of-way of approximately 2 936 square
feet and 1 649 squae feet respectively, more paricularly described in the legal descriptions
attached as Exhbits A, B-1 and B-2 to the City-CIC Cooperation and Payment Agreement; and
WHEREAS , Section 3-10 of the City Charer requires the affirmative vote of four
members of the City Council for the sale of this propert.
NOW , THEREFORE, BE IT ORDAIED by the Council of the City of Alameda, upon
the affirmative vote of four members of the Council that:
Section 1 . The City Manager or the City Manager s designee is hereby authorized and
directed to execute for and behalf on the City of Alameda, the transfer by Grant Deed in
substantially the form attched as Exhibit C to the City-CIC Cooperation and Payment
Agreement that certin City-owned propert (along Atlantic Avenue) to the CIC , subject to the
City-CIC Cooperation and Payment Agreement, and the City Clerk is hereby directed to attest to
the same.

Section 2 . This ordinance shall be in full force and effect from and after the expiration of
thirt (30) days from the date of its final passage.
