APPROVING AND AUTHORIZING THE EXECUTION OF A SUBLEASE
AGREEMENT BETWEEN THE ALAMEDA REUSE AND REDEVELOPMENT
AUTHORITY, AS SUBLESSOR OF THE UNITED STATES OF AMERICA
ACTING THROUGH THE DEPARTMENT OF THE NAVY , AND THE CITY
OF ALAMEDA, AS SUBTENANT, FOR THE USE OF THE ALAMEDA
PO INT GYMNAS IUM AND SWIMMING POOL AND AN AGREEMENT
BETWEEN THE CITY OF ALAMEDA AND ALBANY UNIFIED SCHOOL
DISTRICT FOR USE OF THE ALAMEDA POINT GYMNASIUM
WHEREAS, on February 13 , 1997 , the City of Alameda filed anapplication on behalf of the Alameda Reuse and RedevelopmentAuthority (ARRA) and United States Navy to take over the operation
of the gymnasium and swimming pool.
WHEREAS , the application was approved on July 18, 1997 as
Addendum 9 to the large parcel between the United States of America
and ARRA for occupancy of building #134 and #76; gymnasium and 0
indoor swimming pool; and
WHEREAS , on October 13, 1997, the City of Alameda Planning
Board granted the City of Alameda Use Permit UP-97-42 for operation
of the gymnasium and swimming pool.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City
of Alameda that:
Section 1 . The City of Alameda hereby approves and authorizes
the execution of a Sublease Agreement between the Alameda Reuse and
Redevelopment Authority, as Sublessor of the United States of
America acting through the Department of the Navy, and the City of
Alameda, as Subtenant, for the use of the Alameda Point Gymnasium
and Pool.
Section 2 . The City of Alameda hereby approves and authorizes
the execution of an Agreement between the City of Alameda and
Albany Unified School District for use of the Alameda Point
Gymnasium.
Section 3 The City Manager of the City of Alameda be, and is
hereby authorized to execute for and on behalf of the City of
Alameda , the Sublease Agreement and Agreement substantially in the
form and containing the terms and conditions and covenants as set
out in the Sublease Agreement I a copy of which is attached to the
staff report from the Public Works Department.
Section 4 This ordinance shall be in
