NEW SUB SUBSECTIONS TO SUBSECTION 13-1.2
(MODIFICATIONS , AMNDMENTS AN DELETIONS TO
THE UNORM BUILDING CODE)
BE IT ORDAID by the Council of the City of Alameda that:
Section 1 The Alameda Municipal Code is hereby amended by adding new
sub subsections (a) and (b) and renumbering the subsequent subsubsections to subsection 13-1.2
(Modifications , Amendments and Deletions to the Uniform Building Code) of Chapter XIII
Aricle II to read:
13-1.2 Modifications, Amendments and Deletions to the Uniform Building Code.
a. Section 105.1 of the Uniform Building Code , 1994 edition , is hereby
repealed and a new Section 105.1 is added to read as follows:
Section 105.1 Appeals. Any person adversely affected by any written orders , decisions
or determinations made by the Building Offcial relative to the application and
interpretation of the Alameda Building Code , Alameda Plumbing Code , Alameda
Mechanical Code , the Alameda Electrical Code and the Alameda Fire Code or any other
Alameda building regulations may be appealed to the Housing and Building Code Hearing
and Appeals Board. Such appeal shall be filed no later than ten (10) days following the
date of the written decision by fiing with the Central Permits Offce an appeal form
specifying the basis of the appeaL
b. Section 105.2 of the Uniform Building Code , 1994 edition , is hereby
repealed and a new Section 105.2 is added to read as follows:
Section 105.2 Appeal Fee. The fee for filing an appeal shall be established by resolution
of the City CounciL The appeal fee shall be required to be paid at the time that the appeal
application is filed with the Central Permits Offce. Appeal forms shall not be accepted
without the appropriate appeal fee.

Section 2.If any section , subsection , sentence , clause , or phrase of this
ordinance is , for any reason , held to be invalid or unconstitutional , such decision shall not affect
the validity or constitutionality of the remaining portions of this ordinance. The City Council
the City of Alameda hereby declares that it would have passed this ordinance , and each section
subsection , clause or phrase hereof, irrespective of the fact that anyone or more sections
subsections , sentences , clauses and phrases are declared to be invalid or unconstitutionaL
Section 3 . This ordinance shall be in full force and effect from and after the
expiration ofthirty (30) days from the date of its final passage.
