APPROVING AND AUTHORIZING THE EXECUTION OF A SUBLEASE
AGREEMENT BETWEEN THE ALAMEDA REUSE
REDEVELOPMENT AUTHORITY , AS SUBLESSOR OF AN INTEREST
ACQUIRED FROM THE UNTED STATES OF AMRICA ACTING
THROUGH THE DEPARTMNT OF THE NAVY, AN THE CITY OF
ALAMEDA, AS A SUBTENANT , FOR THE USE OF THE ALAMEDA
POINT TENNS COURTS AS A RECREATIONAL FACILITY
WHEREAS , the United States of America, acting by and though the Deparent of the
Navy, has declared cert facilities surlus at the (former) Naval Ai Station, Alameda; and
WHREAS , the Alameda Reuse and Redevelopment Authority, as lessee of an interest in
the (former) Naval Ai Station (acquired from the United States of America, acting though the
Deparent of the Navy) has immediate need to use the surlus propert; and
WHREAS , such surlus propert may be leased to Stte or local governents pending fial =i
disposition of such propert puruat to the provision of Public Law 94-107 , 10 U.C. 2667(f);and ..
WHEREAS , an application was made on April 22 , 1998 by the Alameda Recreation and
Parks Deparent (ARD) for Plang Board Use Permt, UP-98-14 to allow the conversion of the
former Naval recreationa facilties on Alamed Point (formerly NAS Alameda) to ARD operated Z
facilties to include the leasing of the tenns cour , and daytime use of the existing facilties; and
WHREAS, in July, 1998 , the City of Alamed filed an application for a sublease with the
Alamed Reuse and Redevelopment Authority (AR) for use and operation of the tenns cour
located east of the Main Gate , between Mai Street and W. Red Line Avenue; and.
WHREAS , on Augut 24 , 1998 , the Plang Board of the City of Alameda approved Use
Permit UP-98-, pursuat to Alameda Muncipal Code Section 30-4. 17(c) for the leasing by the
Alameda Recreation and Parks Deparent, of the former Naval tenns cours asARD-operated
recreational facilties.
NOW, THREFORE , BE IT ORDAID by the City Council of the City of Alameda that:
Section 1 . The City Council of the City of Alameda hereby approves and authorizes the
execution of the Sublease Agreement between the Alameda Reuse and Redevelopment Authority,
as sublessor of an interest acquired from the United States of America acting though the Deparent
of the Navy, and the City of Alameda, as subtenant , for the use of the Alameda Point Tenns Cours.
A copy of the sublease agreement is on file in the Offce of the City Clerk.
Section 2 . The City Manager of the City of Alameda, be , and is hereby authorized to
execute , for and behalf of the City of Alameda, the Sublease Agreement, substatially in the form
and contag the terms and conditions and covenants as set out in the Sublease Agreement, a copy
of which is on file in the Office of the City Clerk.
Section 3 . Ths ordinance shall be in full force and effect from and after the expiration ofth (30) days from the date of its final passage.
