ADOPTING A DEVELOPMENT AGREEMENT BETWEEN EDWARD
AND MADL YN MURPHY AND THE CITY OF ALAMEDA , DA-97-
FOR 1.2 ACRES AT THE NORTHEAST CORNER OF BROADWAY
A VENUE AND SANTA CLARA AVENUE TO RETAIN THE USES
AND STANDARDS OF THE R-5/P-D ZONE FOR 25 YEARS. THE
DEVELOPMENT AGREEMENT PERTAINS TO THE ENTIRE SITE
BEING REZONED.
BE IT ORDAINED by the City Council of the City of Alameda that:
Section I.The California Government Code permits Cities to enter into Development
Agreements with propert owners. The applicant has requested a Development Agreement to retain the uses
and standards of the R-5/P-D zone on the propert for 25 years.
Section 2.The Development Agreement applies to 1.7 acres of land area, all the real
propert situated within the City of Alameda, County of Alameda, State of California , described as follows:

Section 3.The Development Agreement is set forth in that certain document on fie in the
offce of the City Clerk.
Section 4.This Ordinance shall be in full force and effective 30 days after City Council
adoption of rezoning R-97-06 or upon execution of the Development Agreement , whichever occurs later.
The City Manager is authorized to execute the Agreement including minor changes in language approved
by the City Attorney which may be consistent with the City Council's direction regarding the Agreement.
Section 4.NOTICE. No judicial proceedings subject to review pursuant to California Code
of Civil Procedure Section 1094.5 may be prosecuted more than ninety (90) days following the date of this
decision or any final action on any appeal , plus extensions authorized by California Code of Civil Procedure
