Ordinance 2791CITY OF ALAMEDA ORDINANCE NO. New Series 2791 APPROVING AND AUTHORIING TH SALE OF CITY -OWNED PROPERTY EAST OF 3274 FILLMORE STREET TO BRIAN PAK WAI YIP AND KITTY CHUI YIP WHREAS , the City of Alameda is the owner of certin real propert situated in the City of Alameda , County of Alameda , State of California , as hereinafter described; and WHREAS , the aforesaid real propert is no longer required by the City of Alameda for municipal purposes , and public convenience and necessity require the disposal of said real property; and WHEREAS, the City has received a purchase offer (Exhibit A) from the owners of property adjacent to the City-owned parcel , said owners being Brian Pak Wai Yip and Kitty Chui Yip ("Buyers ), who would like to purchase the City-owned parcel; and WHEREAS , the parcel under consideration is a small triangular shaped comer (3066 square feet) that resulted from excess street right-of-way that was purchased when the Fernside Boulevard extension was completed in the early 1980's; and WHEREAS , the City has maintained the parcel since then , cutting the weeds and:Dcleaning as needed; and WHEREAS , the parcel is too small to sell as an individual building site as the minimum lot size in Alameda is 5 000 square feet; and WHEREAS , due to the triangular shape of the property, there is only one adjacent property, owned by Buyers , with access to the City-owned property, and Buyers have offered the City $10 000 for the parcel; and WHEREAS , the Buyers wil pay the escrow and recording costs , while the City wil pay for the AL T A title insurance and transfer costs; and WHEREAS , the State of California surplus propert disposal procedures contain an exclusion for parcels less than 5 000 square feet; and WHEREAS, the sale of this property is exempt from CEQA review under CEQA Guideline Section 15312 , " Surplus Government Property Sales ; and C\DA T A \ORDS\LLMORE.ORD WHEREAS , Section 3-10 of the City Charer requires the affirmative vote of four members of the City Council for the sale of this property. NOW , THEREFORE , BE IT ORDAINED by the Council of the City of Alameda upon the affirmative vote of four members of the Council that: Section 1 That the City of Alameda convey unto Buyers , Brian Pak Wai Yip and Kitty Chui Yip, all that certin real property located at the southwest comer of Filmore Street and Fernside Boulevard, commonly known as 3274 Filmore Street, described as a portion of Assessor Parcel No. 69-, 1-, and 1-, and paricularly described as Exhibit B , attached hereto , for and in consideration of the sum of Ten Thousand Dollars ($10 000) to be paid in cash to the City of Alameda by Buyers coincident with the tender of a deed conveying said property. Buyers wil pay the escrow and recording costs , while the City will pay for the AL T A title insurance and transfer costs. Section 2.That the Mayor of the City of Alameda is hereby authorized and directed to execute , for and on behalf of the City of Alameda , a deed conveying said real property to Brian Pak Wai Yip and Kitty Chui Yip, and the City Clerk is directed to attest to same. Section 3 This ordinance shall be in full force and effect from and after the expiration of thirty (30) days from the date of its final passage.
