Ordinance 2816 and Staff ReportCITY OF ALAMEDA ORDINANCE NO. 2816 New Series AMENDING THE ALAMEDA MUCIPAL CODE BY AMENDING SECTION 7 (CITY RECREATION COMMISSION); SUBSECTION 2-1 (COMMISSION CREATED; PUROSE) OF SECTION 2-7 (CITY RECREATION COMMISSION); SECTION 2-(CITY GOLF COMMISSION); SUBSECTION 2-30-1(f) (APPOINTMENTS OF HEADS OF DEPARTMENTS) OF SECTION 2- (DEPARTMENTAL ORGANZATION), OF ARTICLE III (DEPARTMENTS OFFICES AN BURAUS) OF CHATER II (ADMINSTRATION) SUBSECTION 23-5 (HOURS OF PUBLIC USE OF PARS) OF SECTION 23- (pARS AN SQUARS), CHAPTER XXIII (pARS , RECREATION ARAS AND PUBLIC PROPERTY); FOR THE PUROSE OF RENAMING THE RECREATION COMMSSION TO RECREATION AN PAR COMMISSION . BE IT ORDAID by the City Council ofthe City of Alameda that: Section 1.The Alameda Municipal Code is hereby amended by amending Section 7 (City Recreation Commission) and Subsection 2-1 (Commission Created; Purose) of Chapter II (Administration) thereof to read: CITY RECREATION AND PAR COMMISSION Commission Created; Purpose There is hereby created a commission which shall be known as the Recreation and Park Commission of the City of Alameda, whose purose shall be to advise, coordinate and give guidance to the acquisition , development , maintenance and operation of parks , playgrounds , and other recreational facilities in the City of Alameda for the promotion of a sound program of community recreation and avocational activities , using to the greatest practicable extent the land equipment and personnel of the City of Alameda, and the Alameda Unified School Distrct. Section 2.The Alameda Muncipal Code is hereby amended by amending Section 9 (City Golf Commission. 1 ) of Chapter II (Administration) thereof to read: City Golf Commission Editor s Note: Section 2 of Ordinance No. 1696 N.S. provides that the provisions of Section 2-9 of ths Code shall take precedence and be controlling, over any provisions contained in Section 2-7 of this Code , which establishes and sets forth the duties of the Recreation and Park Commission, insofar as the latter conflct with Section 2- Section 3 . The Alameda Muncipal Code is hereby amended by amending Subsection 30-1(f) Recreation Deparent of Subsection 2-30.1 (Appointments of Heads of Departments , of Section 2-30 (Departmental Organization) of Aricle III , (Departments , Offices and Bureaus) of Chapter II (Administration), thereof to read: DEPARTMENTAL ORGANIZATION. 30-1 Appointments of Heads of Departments. Unless otherwise specified herein , the City Manager shall appoint qualified persons to fill the positions required herein and may appoint acting supervisors during periods of vacancy. All such appointees shall serve at the pleasure of the City Manager. f. Recreation Department. The Recreation Department shall be directed by a Director of Recreation and Park who shall be the Secretar to the Recreation and Park Commission and assist the City Manager in the administration of the parks and golf courses. Section 4 . The Alameda Muncipal Code is hereby amended by amending Subsection 23-1.5 (Hours of Public Use of Parks) of Section 23-1 (parks and Squares) of Chapter XXII (parks Recreation Areas and Public Property) thereof to read: 23-PAR AND SQUARS. 23-1.5 Hours of Public Use of Parks. It shall be unawful for any person to be present in any park except durg such hours as the park is open to the public. The Recreation and Park Commission shall by resolution establish the times during which each park is open to the public and shall cause signs therein to be placed conspicuously giving notice of such times and of the hour when the park is closed. The Recreation and Park Commission may except from the foregoing, regularly scheduled activities ofthe Recreation and Park Deparent or groups specifically authorized by the Deparment to use a park beyond its closing time. Section 5 . This Ordinance shall be in full force aTld effect ftom and after the expiration of thirt (30) days ftom the date of its final passage. Background The Recreation Commission was originally created by ordinance in 1952 to provide the Recreation Director with guidance regarding the acquisition , development , maintenance and operation of recreational facilities. They are also responsible for establishing deparmental fees and charges. The Commission not only provides this input regarding recreational programming, but also focuses on issues dealing specifically with Parks. Included among these items is the acquisition of new park sites , design elements amenities for each project, operational policies unique to each facility, and reviewing public comments regarding neighborhood concerns. The term Park was not specifically mentioned in the original ordinance. Discussion Ren!lming of the "Recreation Commission" to the "Recreation and Park Commission would not only describe the duties and responsibilities of the body more clearly but would also identify the Park division as a major component of the Recreation and Park Department's overall operation. There would be no substantive changes in the duties or authority of the Commission as a result of the proposed name change. The City Attorney s offce has determined that in order to accomplish the name change Council would.be required to adopt an.Ordinance amending every Section of the Alameda Municipal Code which currently refers to the "Recreation Commission . The amendment would replace every reference to "Recreation Commission , with "Recreation and Park Commission Municipal Code Cross Reference Should the Council desire to rename the Commission , the Code Sections that would be affected are 2-30-, and 23- Re: Intro of Ordinance #4-D CC 10- Printed on recycled paper Honorable Mayor and Councilmembers Page 2 September 28 , 1999 Budget ConsiderationlFinancial Impact There are no anticipated expenditures associated with the proposed name change.
