APPROVING AN AUTHORIZING THE EXECUTION OF
PERMANENT AN TEMPORAY CONSTRUCTION
EASEMENTS BETWEEN EAST BAY MUCIPAL UTILITY
DISTRICT , A.S GRANTEE AN THE CITY OF ALAMEDA , AS
GRANTOR , FOR THE NAVAL AIR STATION ALAMEDA
REPLACEMENT WASTEWATER INTERCEPTOR SYSTEM
PROJECT
WHEREAS , on May 4 , 1999, the City Council approved an Agreement between East
Bay Muncipal Utility District (EBMU), City of Alameda and the Port of Oakland for Design of
the Alameda Point Estuary Sewer Relocation Project; and
WHREAS , on December 7 , 1999 , the City Council adopted a Negative Declaration
and Mitigation Monitoring Program for the Naval Air Station Alameda Replacement Wastewater
Interceptor System Project; and
WHEREAS , the project relocates the existing sewer serving Alameda Point ITom the
western portion of the Alameda Oakland Estuar to a location approxiinately 1.5 miles to the east
adjacent to the Webster Tube; and
WHREAS , three permanent utility easements are required for the installation ofthe
pipeline , and two temporar constrction easements are required for access , storage and moving
constrction equipment , requiring a total of five easements; and
WHEREAS , the temporar construction easements wil extend ITom the execution
date ofthe agreement (tentatively Januar 1 2000) through December 31 2001; and
WHEREAS , the City of Alameda owns , or administers as Tidelands Trusts , the
underlying propert for all five easements.

NOW , THEREFORE , BE IT ORDAID by the Council of the City of Alameda
Section 1.The City Council ofthe City of Alameda hereby approves and authorizes
the City Manager to execute the permanent and temporar constrction easements between East Bay
Muncipal Utility Distrct , as Gnmtee and the City of Alameda, as Grantor, for the Naval Air Station
Alameda Replacemem .Wastewater Interceptor System project , substantially in the form presented
as Attachment 5 to the memo ITom Matthew Naclerio , Public Works Director, dated November 29
1999 , presented at the City Council meeting of December 7 , 1999.

Section 2 . This ordinance shall be in full force and effect trom and after the
expiration of thirty (30) days from the date of its final passage.
