APPROVING AN AUTHORIZING THE ACCEPTANCE OF PERMANNT
UTILITY MTI TEMPORAY CONSTRUCTION EASEMENTS FROM U.
NAVY , AS GRANTOR AN THE CITY OF ALAMEDA , AS GRATEE
FOR THE NAT AL AI STATION ALAMEDA REPLACEMENT
WASTEWATER INTERCEPTOR SYSTEM PROJECT
WHEREAS, on May 4 , 1999 , the City Council approved an Agreement between East
Bay Muncipal Utility Distrct (EBMU) , City of Alameda and the Port of Oakland for Design of
the Alameda Point Estuary Sewer Relocation Project; and
WHREAS, on December 7, 1999, the City Council adopted a Negative Declaration
and Mitigation Program for the Naval Air Station Alameda Replacement Wastewater Interceptor
System Project; and
WHEREAS, the project relocates the existing sewer serving Alameda Point from the
western portion ofthe Alameda Oakland Estuar to a location approximately 1.5 miles to the east
adjacent to the Webster Tube and includes the rehabilitation of Pump Station No.1; and
WHEREAS , a permanent utility easement along the Main Street property, which is
curently owned in fee by the U.S. Navy, is necessar for the installation and future maintenance
ofthe sewer pipeline; and
WHREAS , an adjacent temporar constrction easement is necessar for access and
storing of constrction equipment across propert owned in fee by the U.S. Navy; and
WHREAS, the Secretar of the Navy has found that the granting of such easement
wil not be incompatible with the public interest.
NOW , THEREFORE , BE IT ORDAID by the Council of the City of Alameda
that:
Section 1 . The City Council of the City of Alameda hereby approves and authorizes
the City Manager to execute the acceptance of 1) a permanent utilty easement and 2) a temporar
construction easement from the U.S. Navy, as Grantor, for the Naval Air Station Alameda
Replacement Wastewater Interceptor System Project , substantially in the form presented as
attachments to thf. memo from Matthew Naclerio , P,:blic Works Director, presented at the City
Council meeting ofFebmar 2000.
Section 2 . This Ordinance shall be in full force and effect from and after the
expiration of thirt (30) days from the date of its final passage.
