Ordinance 2847CITY OF ALAMEDA ORDINANCE NO. 2847 New Series APPROVING (MP A-99-04) AMENDMENT TO THE MASTER PLAN FOR ALAMEDA MARA VILLAGE WHEREAS , an application was made on March 24 , 2000 by Alameda Real Estate Investments , requesting approval of General Plan and Housing Element Amendment , GP A-99- , Master Plan Amendment, MPA-99-, Development Plan , PD-99-, and Design Review . DR-99-121 , to permit the construction of a four-story, 143 000 square foot office building, provide 1.36 acres of public open space and shoreline access , 702 parking spaces and other landscaping improvements , and retain the existing Shipway offce buildings which contain 55 600 square feet of offce use, on the 12.3-acre area encompassing Parcel B ofthe Marna Vilage Master Plan (M); and WHREAS , the application was accepted as complete on May 5 2000; and WHEREAS , by its Ordinance No. 1990 N. S., adopted November 20 , 1979 , the Council approved the MasterPlan for all Alameda Marna Vilage , a projectincorporating residential commercial , recreational , offce and open space uses located on land along the Oakland-Alameda Estuar; and WHREAS , by its ordinance No. 2213 N., adopted October 2 1984 , the Council approved the Master Plan Amendment for Alameda Marna Vilage, which amended the Master Plan Use Diagram for the project permtting Office and Research and Development Use for portions of the Mara Vilage propert; and WHREAS , the Council approved a Master Plan Amendment, MP A-90-, for the uses permtted in Parcels B and C oftheMarna Vilage propert; and WHREAS , Alameda Real Estate Investments ("applicant") has presented to the Council for approval a proposed AmendmenttotheMaster Plan (M A-99-04); and WHREAS , the Planng Board heard and considered this application and on October 2000 , recollended to the Council Certification of the Environmental Ilpact Report , and amendments to the General Plan (GPA-99-09) and to the Master Plan for Alameda Marna Vilage (M A-99-04); and WHREAS, in accordance with section 15070 ofthe CEQA Guidelines the City Council has required changes and alterations to be incorporated into the project , which wil avoid or substantially lessen the potential signficant effects identified in Environmental Ilpact Report; and WHEREAS, on October 17 , 2000 , the Council has adopted a resolution certifying the Environmental Impact Report for Master Plan Amendment , MP A-99-04; WHEREAS, on October 17 , 2000 , the Council has adopted a resolution approving General Plan Amendment , GP A-99-, which would permit a change in land use designation on the General Plan Diagram from "Medium Density Residential" to "Business Park" for an approximately 5.6 acre portion ofthe area identified as Parcel B on the Marina Vilage.property; and WHEREAS, on October 17 2000 , after notice duly given , the Council considered said Amendment to the Master Plan (MP A -99-09), conducted a public hearng,. considered pertinent plans , documents , the Planing Board's recommendation and the staff report and made the following findings: Master Plan Amendment , MP A-99-, subject to the imposed conditions , is in conformance with the adopted General Plan ofthe City of Alameda, as amended by GP A-99-, adopted by a resolution of Council on July 7 , 1992. The Master Plan Amendment , MPA-99-, as conditioned inthis Ordinance, complies with the provisions of the Alameda City Zoning Code , which govern the Mixed Use District. The proposed offce and open space uses are an appropriate mix of uses , well suited to the Marna Vilage projectas a whole. The Master Plan Amendment , MP A-99-, provides suffcient area and encourages adequate public accessibility and usage of the water/land interface. The Master Plan Amendment, MPA-99-asshown onthe conceptual drawing prepared by Ken Kay Associates , dated March 24 , 2000 , consisting of 10 sheets marked Exhibit "A" in the Planng Deparment files , is designed in a maner compatible with existing and potential contiguous uses on the Marna Vilage property. Approval of Master Plan Amendment MPA-99-04 would ensure the productive reuse of the abandoned shipway and fostering orderly growth and quality development in the City. Approval of Master Plan Amendment,.MPA-99-04 would eliminate blighting influences and correcting environmental deficiencies at the project site , including, but not limited to abandoned shipway strctures , depreciated property values and deteriorated public improvements , facilities and utilities. 12. 13. 14. 15. 16. 17. Approval of Master Plan Amendment, MPA-99-04 would permit replanning, redesigning and developing an underdeveloped site to achieve a balanced mix of land uses and complete the Marina Vilage Project. Approval of Master Plan Amendment , MPA-99-04 would strengthen the economic base of the Project area and the community by addition approximately 143 000 gross square feet of offce use. 10.Approval of Master Plan Amendment , MPA-99-04 would seamlessly integrate the Project site into the MarinaVilage development by the design of the new building and adjacentopen space. 11.Approval of Master Plan Amendment, MPA-99-04 would Protect and improve the waterfront by providing public access around the site and linking to the existing shoreline trail that continues throughout Marina Vilage. Master Plan Amendment , MPA-99-, subject to the imposed conditions , is in conformance with the adopted General Plan of the City of Alameda, in accordance with proposed GPA-99-09. The Master Plan Amendment, MPA-99-, as conditioned in this Resolution complies with the provisions of the Alameda City Zoning Code, which govern the Mixed Use District. The Council has been advised that, subject to meeting City standards and requirements , and subject to anendingthe MarnaVilageMaster Plan or the City of Alameda General Plan, the proposed development would be consistent with the Plan for theW est End Community Improvement Project; and WHEREAS, based on the findings , the Council determined that MP A-99-04 should be approved. NOW , THEREFORE , BE IT ORDAID by the Council of the City of Alameda that: Section I.The proposed Amendment to the Master Plan for Alameda Marna Village (MP A-99-04), is hereby approved, subject to the following conditions: SCOPE OF APPROVAL The Scope of Approval is limited to the Proposed Shipway Office as shown on Figure ofthe Marna Vilage MasterPlan Revision prepared by KenKayAssociates , dated March 24 , 2000 , consisting of 10 sheets , marked Exhibit "A" in the Planing Department files. The allowable square footage of gross floor areafor each use (where applicable) shall not exceed that shown on Table 1. Gross floor area is defined as the floor area contained within the exterior walls of the buildings , this includes the total area within the building shell , including corrdors , lavatories , elevators , lobbies etc. DEVELOPMENT PLANS Prior to the issuance of a Building Permit for any construction of the offce building, the applicant shall secure approval of a Development Plan and Design Review. The design elements of the Development Plan shall be compatible with the overall design theme for the entire Marna Vilage Project. The Development Plan and Design Review shall also include detailed landscape plans for shoreline public access. Prior to the issuance of a building permit, the applicant shall obtain Design Review approval for the specific site development and building design of development on Parcel B. The Design Review shall specifically consider at least the following: detailed landscaping design, detailed architectural plans of the buildings , loading areas , trash enclosures , street furniture, security, exterior finishes , signs and lighting fixtures. LANSCAPING Landscaping of common and public areas shall be designed to minimize the use of water and shall be compatible with the soil. Landscaping irrgation systems for common open space shall be equipped with sensor devices so as to conserve water. All sales model complexes , sales offices , temporary sales signs and on and off-site constrction trailers and temporar construction signs shall be reviewed and approved by the Planning Director prior to their constrction and installation. PARG Parking for the offce use shall be provided at the ratio of3.4 spaces per 1 000 of gross building area. PIERHEAD LIN 10.No development, except public access improvement as shown on Exhibit ", may extend beyond the Pierhead Line. MITIGATION MEASURS 11.The Mitigation Measures set out in the Mitigation Monitoring Program approved by the City Council on October 17 , 2000 , are hereby incorporated and included as conditions of the Master Plan Amendment approval. REQUIRED PERMITS 12.Prior to the issuance of a building permit for any portion of development permitted under Master Plan Amendment , MP A-99-, the applicant shall obtain appropriate permits from reviewing agencies including, but not limited to the Bay Conservation and Development Commission and the U. S. Ary Corps of Engineers. MARA VILLAGE MASTER PLAN 13.The Marina Vilage Master Plan Booklet , dated October 2 , 1984 , shall be updated to include amendments thr to and including MP A-99-04. Section 2 . This Ordinance shall be in full force and effect from and after the expiratin of thirty (30) days from the date of its final passage.
