APPROVING AND AUTHORIZING EXECUTION OF LEASE AGREEMENT BETWEEN
GRAND EDIBLES INC., AS LESSEE , AND THE CITY OF ALAMEDA , AS LESSOR , FOR
THE LEASE OF REAL PROPERTY AT 300 ISLAND DRIVE.
WHEREAS , on December 21 , 1982 , by Ordinance No. 2117 , the City of Alameda entered
into a lease with Martin O'Toole for a City of Alameda recreational facility located at the north-
easterly comer ofthe Chuck Corica Golf Complex on Island Drive at Doolittle Drive in the City of
Alameda; and
WHEREAS , on Januar 4 , 1984 , by Ordinance No. 2176 , that lease was assigned by Martin
Toole to Bay Fairway, Inc.; and
WHEREAS , that existing lease on the Bay Fairway Hall terminated on March 1 , 1999; and
WHEREAS , it is now mutually desirable and in the public interest that a lease be entered into
with Grand Edibles Inc.; and
WHEREAS , a form of Lease containing the covenants , terms and conditions to be entered
into is on fie in the Offce of the City Clerk; and
WHEREAS , pursuant to City Charter section 3-, no real property of the City shall be
leased for a period in excess of one year or sold , except upon the affirmative vote of four members
of the City Council.
NOW , THEREFORE , BE IT ORDAINED by the Council of the City of Alameda that:
Section 1 . That the form of lease referred to in the preamble hereof, and the terms
conditions and covenants contained therein , be and the same are approved upon the affirmative vote
of four members of the City Council.
Section 2 . That the City Manager of the City of Alameda or his designee is hereby
authorized to execute , for and on behalf of the City of Alameda , a Lease substantially in the form
and containing the terms and conditions and covenants as set out in the Lease on file in the Offce
of the City Clerk , and the City Clerk is hereby authorized and directed to attest to the same.
Section 3 . This ordinance shall be in full force and effect from and after the expiration of
thiliy (30) days fTOm the date of its final passage.
