APPROVING AND AUTHORIZING EXECUTION OF THIRD LEASE
AMENDMENT BETWEEN MOHAMMAD AN ARDA SHEIKH AS LESSEES
AND THE CITY OF ALAMEDA , AS LESSOR , FOR THE LEASE OF THE
PROPERTY AT 2310 LINCOLN AVENU, LINOAKS MOTEL
WHEREAS , Ordinance No. 2424 , adopted by the City Council on April 5 , 1989 , authorized
acquisition ofthe Linoaks Motel property; and
WHEREAS , on February 6 , 1990 , the City Council authorized leasing of the Linoaks Motel
to Mohammad and Farida Sheikh; and
WHEREAS , Ordinance No. 2620
, ("
First Amendment"), adopted by the City Council on
December 1 , 1992 , authorized the execution of a lease extension for the Linoaks Motel , converting
a month-to-month lease to a two-year lease followed by a month-to-month lease; and
WHEREAS , Ordinance No. 2685 Second Amendment") adopted by the City Council on
February 7 , 1995 , authorized the execution of an amendment to the existing lease agreement with
the Linoaks Motel by reducing the monthly rental rate; and
WHEREAS , the existing Lease is currently month-to-month and a one-year lease is necessar
to provide greater certainty to the parties and the lease amendment specifies the parties ' obligations
should the property be selected as the site for the new main library; and
WHEREAS , pursuant to City Charter section 3-, no real property of the City shall be
leased for a period in excess of one year or sold , except upon the affinnative vote of four members
of the Council.
NOW , THEREFORE , BE IT ORDAINED by the Council of the City of Alameda , by four
affrmative votes that:
Section 1 . That the form of Amendment of Lease referred to in the above , and the terms and
conditions and covenants contained therein are hereby approved.
Section 2 . That the City Manager or his designee is hereby authorized to execute , for and
on behalf of the City of Alameda , the third lease amendment , substantially in the form and
containing the terms and conditions and covenants as set out in the lease attached to the staff report
presented to theCity Council on September 18 , 2001 , and the City Clerk is hereby authorized and
directed to attest to the same.
Section 3 . This ordinance shall be in full force and effect from and after the expiration of
thirty (30) days from the date of its final passage.
