Ordinance 2866CITY OF ALAMEDA ORDINANCE NO. 2866 New Series AMENDING THE ALAMEDA MUCIP AL CODE BY AMENDING SUBSECTIONS 8-9 (REA VY COMMERCIAL VEHICLES) OF CHAPTER VIII (TRAFIC AND MOTOR VEHICLES) TO RESTRICT PARG OF HEAVY COMMERCIAL VEHICLES ALONG FRONTAGE OF CITY PARS BE IT ORDAINED by the Council of the City of Alameda that: Section 1 . The Alameda Municipal Code is hereby amended by repealing existing subsection 8-9 (Heavy Commercial Vehicles) of Chapter VIII (Traffc and Motor Vehicles) in its entirety. Section 2 . The Alameda Municipal Code is hereby amended by adding a new subsection 8- 9 (Heavy Commercial Vehicles) to Chapter VIII (Traffic and Motor Vehicles) to read as follows: Heavy Commercial Vehicles No person shall park a heavy commercial vehicle more than three (3) hours on a street in a residential distrct or in any other area in a residential district that is not substantially concealed by four (4) opaque walls or other enclosures , except: (a) while loading or unloading property when additional time to such three (3) hour period is necessary to complete the work , or (b) when such a vehicle is parked in connection with , and in aid of, the performance of a service to or on a property in the block in which such vehicles parked and when additional time to such three (3) hour period is reasonably necessary to complete such service. Notwithstanding the provisions of this section , parking of heavy commercial vehicles shall be prohibited along the frontage of all City Parks. The prohibition shall be effective whcn appropriate signage is installed giving notice thereof. Records shall be established and maintained in the City Engineer s Offce detailing the location and limits of these prohibitions. For the purose ofthis section "heavy duty commercial vehicles " shall mean either a single vehicle having more than two (2) axles , a single vehicle or combination of vehicles twenty (20') feet or more in length , or a single vehicle or combination of vehicles six (6') feet , eight (8") inches or more in width , an automobile dismantler s tow vehicle , or a single vehicle or combination of vehicles satisfying the definition of "tow truck" in California Vehicle Code Section 615 , and shall include but shall not be limited to dump trucks , moving vans , tractors , pole , pipe dollies , and tow trucks including those of automobile dismantlers. This section shall not apply to recreational vehicles. Section 3.This ordinance shall be in full force and effect from and after the expiration of thirty (30) days from the date of its final passage.
